It was stressed that some conflicts could not be mitigated, such as those that might arise if a consultant who had participated in formulating the terms and conditions of the procurement subsequently presented a submission.
وشُدد على أن بعض حالات التضارب لا يمكن تخفيفها، مثل الحالات التي قد تنشأ إذا شارك خبير استشاري في صياغة أحكام الاشتراء وشروطه ثم قدم عرضا فيما بعد.

(b) In revising the relevant terms and conditions of the procurement, the procuring entity may:

Deviations from the requirement to provide exhaustive information about the terms and conditions of the procurement at the time of solicitation of participation in the framework agreement procedure are permitted only so far as needed to accommodate the procurement concerned.
7- وحالات الخروج عن اشتراط توفير معلومات مستفيضة عن أحكام الاشتراء وشروطه حين التماس المشاركة في إجراء الاتفاق الإطاري لا يُسمح بها إلاّ بالمقدار المطلوب لمواءمة عملية الاشتراء المعنية.

Suppliers' or contractors' submissions may be binding under the law of the enacting State; under a closed framework agreement without second-stage competition, the terms and conditions of the procurement are set and the first-stage submissions will be enforceable in the normal manner.
ويجوز أن تكون عروض المورِّدين أو المقاولين ملزمة بمقتضى قانون الدولة المشترعة؛ أما في الاتفاق الإطاري المغلق الذي لا ينطوي على مرحلة تنافس ثانية، فتُحدّد أحكام الاشتراء وشروطه وتكون عروض المرحلة الأولى قابلة للإنفاذ بالطريقة المعتادة.

The procurement regulations may usefully emphasize that holding the discussions is an option, not an obligation: the procuring entity may be able to refine and finalize the terms and conditions of the procurement without holding the discussion, on the basis of the initial tenders received.
وقد يكون من المفيد أن تؤكد لوائح الاشتراء على أنَّ إجراء المناقشة أمرٌ اختياري وليس التزاما: قد تكون الجهة المشترية قادرة على تنقيح أحكام الاشتراء وشروطه ووضعها في صيغتها النهائية دون عقد المناقشة، وذلك استناداً إلى العطاءات الأولية المتلقّاة.

6. As noted in the context of the closed framework agreements above, the procurement regulations are to explain the operation of the permissible range of refinements to the terms and conditions of the procurement, including the relative weights of the evaluation criteria and subcriteria, through second-stage competition.
