The Committee recommends that the State party amend article 27 of the Labour Code in order to remove this condition and ensure that all migrant workers benefit from equal treatment in respect of remuneration and other conditions of work and employment.

The Committee urges the State party to ensure that all migrant workers and members of their families within its territory or subject to its jurisdiction enjoy, without discrimination, the rights recognized by the Convention, in accordance with article 7 thereof.
21- تحث اللجنة الدولة الطرف على كفالة تمتع جميع العمال المهاجرين وأفراد أسرهم الموجودين على أراضيها أو الخاضعين لولايتها بالحقوق المعترف بها في الاتفاقية دون تمييز، وفقاً للمادة 7 منها.

67- وفيما يتعلق بالضمان الاجتماعي، تنص الفقرة 1 من المادة 27 من الاتفاقية على وجوب تمتع جميع العمال المهاجرين وأفراد أسرهم بنفس المعاملة التي يعامل بها مواطنو دولة العمل ما داموا يستوفون الشروط التي ينص عليها التشريع المنطبق في تلك الدولة والمعاهدات الثنائية والمتعددة الأطراف المنطبقة فيها.
