Thus, if a State Party has violated Article I or II, that State cannot argue that article IV protects it from the consequences of breach, including the imposition of measures by other States against its nuclear program.

The report also points out that article IV confirms this inalienable right since it is clearly a pre-existing right under the Treaty and can therefore be amended or restricted only by an express agreement between the parties.

7. The Conference states that article IV does not provide States Parties that have violated the non-proliferation provisions of the Treaty any protection from the consequences of these violations, including the imposition of measures against their nuclear programmes.

For instance, it must be ensured that article IV (Increasing Participation of Developing Countries) be built into countries’ commitments, as this has not yet been applied.

13. Notwithstanding the fact that article IV of the BTWC does not explicitly refer to implementing legislation, the database documents show that most of the States Parties follow the bona fide interpretation of the Convention that necessitates legally binding implementing measures.

The Embassy reiterates the point, made in its aide-mémoire of 16 January 1996, that article IV of the Convention, and the so-called Chairman's statement of 1980, recognize that parties to the Convention with islands within its area of application may exercise coastal state jurisdiction in respect of those islands.

6. The Syrian Arab Republic considers that article IV of the Treaty gave all parties to the Treaty the unshakable and inalienable right to acquire nuclear technology for various peaceful purposes, striking a balance between State rights and responsibilities and without discrimination or double standards.
6 - ترى الجمهورية العربية السورية أن المادة الرابعة من معاهدة عدم انتشار الأسلحة النووية، قد أعطت جميع الدول الأطراف، حقاً ثابتاً وغير قابل للتصرف في الحصول على التكنولوجيا النووية لاستخدامها في مختلف التطبيقات السلمية، وذلك بشكل متوازن بين حقوق تلك الدول وواجباتها، دون أي تمييز وبعيداً عن الازدواجية في المعايير.

32. His delegation also wished to reaffirm its understanding that article IV of the Treaty vested States parties, and particularly the non-nuclear-weapon States, with the inalienable right to develop research, and production and use of nuclear energy and to participate in the fullest possible exchange of equipment, materials and technology for peaceful purposes, without discrimination and in accordance with their respective safeguards agreements.
32 - وأضاف أن وفد بلده يرغب أيضا في أن يؤكد من جديد فهمه أن المادة الرابعة من المعاهدة تعطي الدول الأطراف، وبخاصة الدول غير الحائزة للأسلحة النووية، الحق غير القابل للتصرف في تطوير البحث في مجال الطاقة النووية وإنتاج هذه الطاقة واستعمالها في الأغراض السلمية، وفي المشاركة في أتم تبادل ممكن للمعدات والمواد والتكنولوجيا للأغراض السلمية دون تمييز ووفقا لاتفاقاتها بشأن الضمانات.

The court held that article IV NYC prevailed over a more lenient provision in German civil procedure law (§1064 (1) ZPO) for domestic awards, which was in principle also applicable to foreign awards " unless otherwise provided in treaties " .

We recall that article IV of the NPT stipulates that nothing in the Treaty shall be interpreted as affecting the inalienable right of all the Parties to the Treaty to develop research, production and use of nuclear energy for peaceful purposes without discrimination and in conformity with Articles I and II of the Treaty.
نذَكر بأن المادة الرابعة من معاهدة عدم الانتشار تنص على أن ليس في المعاهدة ما يمكن تفسيره على أنه يخل بالحقوق غير القابلة للتغيير التي تملكها جميع الدول الأطراف في المعاهدة في إنماء بحث وإنتاج واستخدام الطاقة النووية للأغراض السلمية دون أي تمييز ووفقاً للمادتين الأولى والثانية من هذه المعاهدة.

Some States Parties have argued that article IV provides an unconditional right to nuclear energy for peaceful purposes, regardless of its proliferation implications, and that steps by other States to deny them any technology somehow violates their " inalienable " rights or their rights under the NPT.
وقد احتجت بعض الدول الأطراف بأن المادة الرابعة تمنح حقاً غير مشروط في استخدام الطاقة النووية للأغراض السلمية، بغض النظر عما لهذا الاستخدام من تداعيات تتعلق بالانتشار، وأن الخطوات التي تتخذها دول أخرى لحرمانها من الوصول إلى أي تكنولوجيا ينتهك إلى حد ما حقوقها " غير القابلة للتصرف " أو حقوقها بموجب معاهدة عدم الانتشار.
