" (b) To supply information that cannot be obtained in the normal course of the administration of that Contracting State or is not obtainable under the laws of that Contracting State or of the other Contracting State; "
" (ب) تقديم معلومات يتعذر الحصول عليها في إطار الممارسات الإدارية الاعتيادية لتلك الدولة المتعاقدة أو يتعذر الحصول عليها بموجب قوانين تلك الدولة المتعاقدة أو الدولة المتعاقدة الأخرى؛ "

In no case shall the provisions of this Article be construed to permit a Contracting State to decline to supply information solely because the conduct being investigated would not constitute a crime under the laws of that Contracting State if such conduct occurred in that Contracting State.
وينبغي ألا تفسر بأي حال من الأحوال الأحكام الواردة في هذه المادة على أنها تسمح للدولة المتعاقدة بأن تمتنع عن توفير المعلومات لمجرد أن السلوك الخاضع للتحقيق لا يشكِّل جريمة بموجب قوانين تلك الدولة المتعاقدة إذا وقع هذا السلوك في تلك الدولة المتعاقدة.

1. A decision made by a court having jurisdiction under this Convention shall be recognized and enforced in another Contracting State in accordance with the law of that Contracting State when both States have made a declaration in accordance with article 76.
١- يجب الاعتراف بالقرار الذي تصدره المحكمة التي لها ولاية بمقتضى هذه الاتفاقية وإنفاذه في دولة متعاقدة أخرى وفقا لقانون تلك الدولة المتعاقدة عندما تكون كلتا الدولتين قد أصدرتا إعلانا وفقا للمادة ٧6.

" (b) To supply information that cannot be obtained in the normal course of the administration of that Contracting State or is not obtainable under the laws of that Contracting State or of the other Contracting State; "
" (ب) تقديم معلومات يتعذر الحصول عليها في إطار الممارسات الإدارية العادية لتلك الدولة المتعاقدة أو يتعذر الحصول عليها بموجب قوانين تلك الدولة المتعاقدة أو الدولة المتعاقدة الأخرى " ؛

6. A Contracting State shall exchange information with the other Contracting State pursuant to this article 26 without regard to whether the conduct being investigated would constitute a crime under the laws of that Contracting State if such conduct occurred in that Contracting State.
6 - تقوم الدولة المتعاقدة بتبادل المعلومات مع الدولة المتعاقدة الأخرى عملاً بالمادة 26 بصرف النظر عما إذا كان السلوك الجاري التحقيق فيه يشكل جريمة بموجب قوانين تلك الدولة المتعاقدة إذا حدث هذا السلوك في تلك الدولة المتعاقدة.

However, that proposal was objected to on the grounds that the right of a State to denounce an international convention was a sovereign right and that the inclusion of possible limitations to that right, including any obligation of a Contracting State to protect the rights of third parties, might be perceived as restricting the sovereignty of that Contracting State.
٣٥١ - غير أن هذا الاقتراح لوقي بالاعتراض بحجة أن حق دولة في نقض اتفاقية دولية هو حق سيادة وأن ادراج أي قيود محتملة لهذا الحق ، بما في ذلك أي التزام من أي دولة متعاقدة حماية حقوق أطراف ثالثة ، يمكن أن يعتبر تقييدا لسيادة تلك الدولة المتعاقدة .

Therefore, article 12 enables a Contracting State to make a declaration under article 96 to prevent the application of any provision of article 11, article 29 or Part II of the Convention which allows a contract of sale or its modification or termination by agreement or any offer, acceptance, or other indication of intention to be made in any form other than in writing where any party has his place of business in that Contracting State.
ولذلك فإنّ المادّة 12 تمكّن أي دولة متعاقدة من إصدار إعلان بمقتضى المادّة 96 لمنع تطبيق أي حكم من أحكام المادّة 11 أو المادّة 29 أو الجزء الثاني من هذه الاتفاقيّة، يجيز إبرام عقد بيع أو تعديله أو إنهائه بالاتفاق أو أي إيجاب أو قبول أو أي بيان بالنيّة بصورة غير خطيّة في الحالات التي يكون فيها مكان عمل أحد الطرفين في تلك الدولة المتعاقدة.

" 6. A Contracting State shall exchange information with the other Contracting State pursuant to this Article without regard to whether the conduct being investigated would constitute a crime under the laws of that Contracting State if such conduct occurred in that Contracting State. "
" 6 - تتبادل الدولة المتعاقدة المعلومات مع الدولة المتعاقدة الأخرى عملا بأحكام هذه المادة بغض النظر عما إذا كان السلوك الخاضع للتحقيق يشكل جريمة بموجب قوانين تلك الدولة المتعاقدة إذا كان هذا السلوك قد وقع في تلك الدولة المتعاقدة " .

" (a) To carry out administrative measures at variance with the laws and administrative practice of that Contracting State or of the other Contracting State even if that Contracting State knows and fails to disclose that specific provisions of its laws or administrative practice are likely to prevent an effective exchange of information; "
" (أ) اتخاذ تدابير إدارية تتنافى مع القوانين والممارسات الإدارية للدولة المتعاقدة أو للدولة المتعاقدة الأخرى حتى إذا كانت تلك الدولة المتعاقدة تدرك أن أحكاما محددة ترد في قوانينها أو ممارساتها الإدارية من شأنها أن تحول دون التبادل الفعال للمعلومات، ولا تقوم بالإفصاح عن ذلك " ؛
