Article 12 of the Convention against Torture expressly obligates States parties to investigate all allegations of torture, asserting that each State party should ensure that its competent authorities proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.

On the basis of this article and related article 16, the State must ensure that its competent authorities proceed to a prompt and impartial investigation when there is reason to believe that under its jurisdiction an act of torture or cruel, inhuman or degrading treatment or punishment has been committed.
21- بمقتضى هذه المادة والمادة 16 التي لها صلة بها، يجب على الدولة أن تكفل قيام سلطاتها المختصة بإجراء تحقيق فوري ونزيه عندما يكون هناك ما يدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب أو المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة ارتُكِب في الأراضي الخاضعة لولايتها.

The Working Group recalls that pursuant to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which Bahrain is a party, the Government, " shall ensure that its competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed " (art. 12).
ويذكر الفريق العامل بأنه عملاً باتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، التي أصبحت البحرين طرفاً فيها، على الحكومة " أن تضمن قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه، كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب " (المادة 12).

The Working Group further recalls that, pursuant to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which Bahrain is also a party, the Government " shall ensure that its competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction " (article 12).
29- ويذكّر الفريق العامل كذلك بأن اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، التي انضمت إليها البحرين أيضاً، تنص على أن تكفل الحكومة " قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها القضائية " (المادة 12).

7.3 The Committee considers that the points outlined in the previous paragraph indicate a failure to investigate on the part of the authorities mentioned therein that is incompatible with the obligation on the State, under article 12 of the Convention, to ensure that its competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed.
7-3 وترى اللجنة أن النقاط الواردة في الفقرة السابقة تشير إلى وجود قصور في التحقيق من جانب السلطات المذكورة في تلك الفقرة لا يتفق مع التزام الدولة بموجب المادة 12 من الاتفاقية بضمان قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه كلما كانت هناك أسباب معقولة تدعو للاعتقاد بأن فعل من أفعال التعذيب قد ارتكب.

The State party contends that its competent authorities have carried out a comprehensive examination of the alleged use of unlawful methods of investigations and torture against the author's son, both during the preliminary investigation and the court trial.
وتؤكد الدولة الطرف أن سلطاتها المختصة أجرت تحريات مستفيضة في الادعاء باللجوء إلى أساليب غير مشروعة في التحقيقات وفي الادعاء بتعرض ابنها للتعذيب، سواء أثناء التحقيقات الأولية أو أثناء المحاكمة.

CERD recommended, inter alia, that the State ensure that its competent authorities proceed to a prompt and impartial investigation into complaints of ill-treatment increase its efforts to provide adequate training in the field of human rights, including on the prohibition of racial discrimination, to its law enforcement personnel.
