The Covenant goes on to say that " no one shall be deprived of his liberty except on such grounds and in accordance with such procedure as are established by law " .
ويوضح العهد أيضاً بأنه " لا يجوز حرمان أحد من حريته إلا لأسباب ينص عليها القانون وطبقاً للإجراء المقرر فيه " .

28. Article 9 of the Universal Declaration prohibits arbitrary arrest and detention declaring that, " no one shall be subjected to arbitrary arrest, detention or exile " .
28- تحظر المادة 9 من الإعلان العالمي لحقوق الإنسان التوقيف أو الاحتجاز التعسفي حيث تقضي بأنه " لا يجوز اعتقال أي إنسان أو حجزه أو نفيه تعسفاً " .

Reaffirming that no one shall be subjected to arbitrary arrest or detention and that everyone is entitled in full equality to a fair and public hearing, by an independent and impartial tribunal, in the determination of their rights and obligations and of any criminal charge against them,
وإذ تؤكد من جديد عدم جواز إخضاع أي فرد للتوقيف أو الاحتجاز التعسفي، وأن لكل شخص الحق في المحاكمة على قدم المساواة الكاملة محاكمة نزيهة وعلنية في محكمة مستقلة ونزيهة تحدد حقوقه والتزاماته وأية تهمة جنائية توجه إليه،

Paragraph 1 of article 9 also provides that no one shall be subjected to arbitrary arrest or detention.
573- وتنص الفقرة 1 من المادة 9 أيضاً على عدم جواز توقيف أحد أو اعتقاله تعسفاً.
