The Special Rapporteur recalls that persons deprived of their liberty find themselves in a situation of enhanced vulnerability since prison authorities are given total control over the most basic activities of the inmates, including over what they eat.

18. SPT reminded Benin that persons deprived of their liberty by law enforcement officials should not be subject to restraint while in custody and disciplinary cells.
18- وذكّرت اللجنة الفرعية لمنع التعذيب بنن بأن الأشخاص المحرومين من حريتهم على أيدي مسؤولي إنفاذ القوانين لا ينبغي تقييدهم أثناء وجودهم رهن الحبس الاحتياطي وفي الزنزانات التأديبية.

The Committee recalled that persons deprived of their liberty may not be subjected to any hardship or constraint other than that resulting from the deprivation of liberty; they must be treated in accordance with, inter alia, the Standard Minimum Rules for the Treatment of Prisoners.

10. The Committee is concerned about numerous allegations that persons deprived of their liberty were subjected to torture or ill-treatment for the purpose of compelling a forced confession, and that such confessions were subsequently admitted as evidence in court in the absence of a thorough investigation into the torture allegations.

124. The State of Kuwait provides all safeguards ensuring that persons deprived of their liberty are treated appropriately and with respect for their dignity.
124- توفر دولة الكويت كافة الضمانات التي تكفل حصول الأشخاص المحرومين من حرياتهم على المعاملة اللائقة واحترام كرامتهم.

54. The delegation indicated that persons deprived of their liberty were considered a priority group for State action.

Conditions of detention in prisons, in particular in maximum security prisons, should be scrutinized with a view to guaranteeing that persons deprived of their liberty be treated with humanity and with respect for the inherent dignity of the human person, and implementing the United Nations Standard Minimum Rules for the Treatment of Prisoners and the Code of Conduct for Law Enforcement Officials therein.
