5.2 As to the State party's claim that she has not exhausted all available domestic remedies, the author submits that, according to the Committee's jurisprudence, in States where the decision on the review of court decisions under the supervisory procedure is dependent on the discretionary power of a limited number of officials, the exhaustion of domestic remedies is limited to the cassation proceedings.

4.13 As to the complainant's allegation that she suffers from mental health problems, in particular from depression with somatic syndrome, that there is a suspicion of post-traumatic stress disorder and that she would be at serious risk of suicide if forcibly returned to Turkey, the State party finds it surprising that she has not invoked her mental health problems during the asylum proceedings.

The Committee also notes that, according to the State party, the author has simply written letters to political and administrative authorities and petitioned advisory or mediation bodies and representatives of the prosecution service and that she has not, strictly speaking, initiated legal action and seen it through to its conclusion by availing herself of all available remedies of appeal.
