12. Pursuant to article 2, paragraph 3 (a), of the Covenant, the Committee considers that the author is entitled to an effective remedy, including appropriate compensation for the violations suffered.
12- وعملاً بالفقرة 3(أ) من المادة 2 من العهد، ترى اللجنة أن لصاحبة البلاغ الحق في سبيل فعال للتظلم يشمل تعويضاً مناسباً عما تعرضت لـه من انتهاكات.

14. In accordance with article 2, paragraph 3 (a), of the Covenant, the Committee considers that the author is entitled to an effective remedy.
14- وعملاً بالفقرة 3(أ) من المادة 2 من العهد، ترى اللجنة أن من حق صاحب البلاغ أن يتاح لـه سبيل تظلم فعال.

The author's assertions are not credible and there is no objective evidence to support a finding that the author is at personal risk if he returns to Sri Lanka.
ذلك أن تأكيدات صاحب البلاغ تفتقر إلى المصداقية ولا يوجد دليل موضوعي يفيد بأن صاحب البلاغ معرض لخطر شخصي إذا عاد إلى سري لانكا.

The State party also notes that the author is not claiming any personal impact on his health or his environment.
ومن جهة أخرى تلاحظ الدولة الطرف أن صاحب البلاغ لا يشكو من أي ضرر شخصي أصيب به في صحته أو في بيئته.

These circumstances conflict with the assertion that the author is of particular interest to the Iranian authorities.
وهذه الملابسات تتعارض مع التأكيد بأن مقدم البلاغ موضع اهتمام خاص للسلطات اﻹيرانية.

4.15 As such, there is nothing to suggest that the author is at personal risk of torture or ill-treatment in Sri Lanka.
4-15 وعليه لا يوجد ما يشير إلى أن صاحب البلاغ معرض لخطر شخصي بالتعذيب أو سوء المعاملة في سري لانكا.

Their decision not to have recourse to that possibility indicates that the author is not of particular interest for them.
وقرار تلك السلطات بعدم اللجوء إلى تلك اﻹمكانية يشير إلى أن صاحب البلاغ ليس ذا أهمية كبيرة لدى تلك السلطات.

I would also point out that the author is not qualified to submit a communication on behalf of those groups of women, under the terms of article 2 of the Optional Protocol.
وأود أن أشير أيضاً إلى أن صاحبة البلاغ لا تملك الصفة لتقديم بلاغ بالنيابة عن هذه المجموعات من النساء بموجب المادة 2 من البروتوكول الاختياري.

It therefore concludes that the author is the victim of a violation by the State party of his rights under article 19, paragraph 2, of the Covenant.
وتخلص اللجنة بالتالي إلى أن صاحب البلاغ قد تعرض لانتهاك الدولة الطرف لحقه المكفول بموجب الفقرة 2 من المادة 19 من العهد.

Therefore, the Committee concludes that the author is a victim of a violation of article 14, paragraph 5, of the Covenant.

From the decisions handed down during the extradition proceedings it may be inferred that the author is the person whose extradition was formally requested by the United States Government.

4.4 Should it be found that the author is entitled to reparation for damage and injury, mechanisms for lodging such claims are available under domestic legislation.

8. Pursuant to article 2, paragraph 3 (a), of the Covenant, the Committee considers that the author is entitled to an appropriate remedy, including compensation and either his retrial or his release.
8- وعملاً بأحكام الفقرة 3(أ) من المادة 2 من العهد، ترى اللجنة أن لصاحبة البلاغ الحق في الاستفادة من سبيل انتصاف مناسب يشمل التعويض عن الضرر وحتى إعادة محاكمة المحكوم عليه أو الإفراج عنه.

It submitted that it does not accept the Committee's finding that Australia has violated article 26 and therefore rejects the conclusion that the author is entitled to an effective remedy.
وتذكر الدولة الطرف أنها لا تقبل الاستنتاجات التي خلصت إليها اللجنة بأن أستراليا قد انتهكت أحكام المادة 26، ولذلك فهي ترفض الاستنتاج الذي يعتبر أن من حق صاحب البلاغ أن يستفيد من سبيل انتصاف فعال.
