7.9 Finally, as to the medical record submitted in the framework of this communication, the Committee observes that the complainant has not provided any explanation as to why he did not present it before the State party's authorities, and that, in any event, nothing in the said record brings additional pertinent details on his alleged past ill-treatment.
7-9 وأخيراً، فيما يتعلق بالسجل الطبي المقدَّم في إطار هذا البلاغ، تلاحظ اللجنة أن صاحب الشكوى لم يُدلِ بأي تفسير لعدم تقديمه إلى سلطات الدولة الطرف، وأن السجل المذكور لا يتضمن على أي حال ما من شأنه أن يأتي بتفاصيل إضافية تتصل بإساءة معاملته المزعومة في الماضي.

It further observes that the complainant has not provided sufficient evidence to corroborate his assertions of having been subjected to torture in Costa Rica.

4.5 The State party submits that the complainant has not provided sufficient evidence in substantiation of his claim that, by extraditing him, Australia will breach article 3 of the Convention.

5.3 The State party submits that the complainant has not provided any details or corroborating evidence such as medical reports or scarring of his alleged torture by the Military Security Police in 1992, and thus certainly not in any recent past.
5-3 وتقول الدولة الطرف إن صاحب البلاغ لم يقدم أي تفاصيل أو أدلة داعمة كتقارير طبية أو آثار للجروح الناجمة عن تعذيبه المزعوم على أيدي شرطة الأمن العسكري في عام 1992، وهو ما يعني بالتأكيد أن ذلك لم يحدث في ماضٍ قريب.

However, the Committee notes that the complainant has not provided sufficient information to support his claim that Tatars, and therefore he himself, are discriminated against to the extent that would place him at a particular risk of torture in Uzbekistan.

In this regard, the Committee notes that the complainant has not provided any information on the costs of legal representation or court fees, nor on the possibilities or any efforts on his part to obtain legal aid for the purpose of initiating proceedings before the Federal Court.

For the above-mentioned reasons, the Committee finds that the complainant has not provided substantial grounds for believing that he would be in danger of being tortured were he to be returned to Tunisia and that such danger is personal and present.
وترى اللجنة للأسباب السالفة الذكر، أن مقدم الشكوى لم يقدم أسباباً قوية تدعو إلى الاعتقاد بأنه سيكون في خطر التعذيب إذا أعيد إلى تونس وأن هذا الخطر شخصي وقائم.
