Article 26, paragraph 1 of the Declaration acknowledges indigenous peoples' right to the lands, territories and resources they have traditionally owned, occupied or otherwise used, while article 26, paragraph 2 refers to the lands, territories and resources that they possess by reason of traditional ownership or other traditional occupation or use.

For indigenous peoples, many of whom are pastoralists, article 36 has special relevance:
