4.3.1 With regard to the alleged violation of article 26, the State party contends the communication is inadmissible ratione materiae, or, in the alternative, does not constitute a violation.

9.5 Accordingly, the Committee decides that the complaint is admissible in respect of the alleged violation of article 3 of the Convention based on the return of the complainant to India.

4.2 With respect to the alleged violation of articles 7 and 10, paragraph 1, of the Covenant on the ground of " agony of suspense " suffered by the author due to the five years spent on death row, the State party submits that a prolonged stay on death row does not per se constitute cruel and inhuman treatment.

For the above reasons, without prejudging the alleged violation of the Covenant by the State party, we are of the opinion that the Committee should have declared the communication Marin v. France to be admissible.
