5.4 The authors argue that although " intention " is required in violation of article 1 of the Anti-Racism Law 927/79, it is not for violations of article 2 and that an incorrect notion of intent was applied by the court.

7.1 The Committee notes that the authors claim violations of article 26 in conjunction with article 2 of the Covenant, insofar as the Anti-Racism Law 927/79 is said to be inadequate for the purpose of protecting individuals against discrimination and because in this case the courts application of the law failed to protect the first and second authors from discrimination based on racial origin.
7-1 تلاحظ اللجنة أن أصحاب البلاغ يدعون وجود انتهاك للمادة 26 مقترنة بالمادة 2 من العهد، من حيث إن قانون مكافحة العنصرية 927/79 على حد قولهم لا يوفر للأفراد حماية كافية من التمييز، ولأن تطبيق المحكمة للقانون في هذه القضية لم يحم صاحبتي البلاغ الأولى والثانية من التمييز على أساس الأصل العرقي.

Upon a thorough review of the information before it, and bearing in mind the conflicting views of the authors and State party, the Committee finds that the authors have failed to demonstrate that either the terms of the Anti-Racism Law 927/79 or the application of the law by the courts discriminated against them within the terms of article 26.
وترى اللجنة بعد إجراء استعراض متعمق للمعلومات المعروضة عليها، ومع مراعاة الآراء المتضاربة لأصحاب البلاغ والدولة الطرف، أن أصحاب البلاغ لم يثبتوا أن أحكام قانون مكافحة العنصرية 927/79 أو تطبيق هذا القانون من جانب المحكمة يشكلان تمييزاً ضدهم بالمفهوم الوارد في المادة 26.

The authors took their case to the Committee, claiming to be the victims of a violation by the State party of article 20, paragraph 2, read in conjunction with article 2, paragraph 1, of the Covenant, because the court " failed to appreciate the racist nature of the impugned letter and to effectively implement the Anti-Racism Law 927/1979 aimed at prohibiting dissemination of racist speech " .
