On the question of whether such a judgement could be pronounced without giving the parties the opportunity to exchange views and put forward additional arguments, the Arbitration Court had come to the conclusion that it was entitled to pronounce such a judgement, since the subject of the arbitration proceedings was compliance with the guarantee and not any other legal relations between the parties.
