The State party concludes that the author's allegations under article 7 of the Covenant are ill-founded.

4.8 Concerning the author's allegations under article 26, the State party notes that this allegation is not substantiated and was not addressed before national courts.

7.7 With regard to the author's allegations under articles 13 and 14, the Committee recalls that the guarantees of impartiality, fairness and equality enshrined in article 14, paragraph 1, and article 13 of the Covenant must be respected by all bodies exercising a judicial function.

4.27 Regarding the author's allegations under article 9 of the Covenant, the State party reiterates its previous arguments, and stresses that the requirements prescribed by this provision were observed in this case, and that considerable attention was paid to the author's health status when deciding the restraint measure.

4.9 Regarding the author's allegations under article 14 of the Covenant, the State party argues that he himself freely admitted that he was in the apartment when the murders took place, that he did not report the crime to the authorities, and that he took the handbag from the crime scene.

6.5 The State party reiterates that the communication should be deemed inadmissible on the grounds that the author's allegations under articles 6 and 7 of the Covenant are manifestly unfounded; that his allegations of violations of articles 2, 9 and 14 are incompatible with the provisions of the Covenant; and that he has failed to exhaust domestic remedies in respect of the new allegations raised in his reply submission.

7.5 The Committee notes the author's allegations under article 14, paragraph 1, that his trial was unfair and biased as the sentence was based on the evidence obtained with procedural violations.

1.2 During its eighty-seventh session, on 6 July 2006, the Committee considered the admissibility of the communication, and declared the author's allegations under article 9; article 14 paragraphs 1, 3 (b), and 7 of the Covenant admissible.
