The Committee considers that, in the absence of any pertinent explanations from the State party, the restrictions of the exercise of the author's freedom to seek, receive and impart information and ideas, although permitted under domestic law, cannot be deemed necessary for the protection of national security or of public order (ordre public) or for respect of the rights or reputations of others.

The Committee therefore concluded that the regulation requiring persons to appear bareheaded in their passport photographs was a disproportionate limitation that infringed the author's freedom of religion and constituted a violation of article 18 of the Covenant.

10.3 The Committee has next to consider whether the restrictions imposed on the author's freedom to impart information are justified under any of the criteria set out in article 19, paragraph 3, of the Covenant.

By doing so, the AttorneyGeneral violated the author's freedom of expression under article 19 of the Covenant, as well as his right to equality and equal protection of the law guaranteed by article 26.

In the absence of any explanation from the State party justifying the restrictions to which the author has been subjected, pursuant to paragraph 3 of article 12, the Committee is of the opinion that the restriction of the author's freedom of movement and residence is in violation of article 12, paragraph 1, of the Covenant.

It reiterates that freedom of employment is not protected by the Covenant on Civil and Political Rights and that the Committee thus has no jurisdiction to evaluate whether the restriction of the author's freedom of employment is excessive unless it can be demonstrated that the restriction constituted a violation of article 26 of the Covenant.
وتكرر أن العهد الدولي الخاص بالحقوق المدنية والسياسية لا يحمي حرية العمل ومن ثم فإن اللجنة لا تملك اختصاص تقييم ما إذا كان تقييد حرية صاحب البلاغ في العمل يتسم بالإفراط ما لم يقم الدليل على أن التقييد ينتهك المادة ٢٦ من العهد.

It cannot, therefore, accept the claim that the author's freedom of expression was restricted by the Board of Inquiry's Order of 28 August 1991 as upheld by the Supreme Court of Canada, since that Order was in keeping with article 19, paragraph 3, of the Covenant.
