14. Articles 43, 47, 48, 49 and 53 of the Basic Law of Government specify these remedies, the most important of which are:
14- وضح النظام الأساسي للحكم بالمواد 43 و47 و48 و49 و53 وسائل الانتصاف، وأهمها:

(a) The Constitution of the Kingdom of Saudi Arabia is the Book of God and the Sunna of His Prophet, as stipulated in article 7 of the Basic Law of Government, which reads as follows:
(أ) دستور المملكة العربية السعودية كتاب الله وسنة رسوله. وهو ما نصت عليه المادة 7 من النظام الأساسي للحكم حيث تنص على:

(b) the Basic Law of Government, whose article 26 stipulates: " The State shall protect human rights in accordance with the Islamic sharia. "
(ب) النظام الأساسي للحكم: حيث تنص المادة 26 منه على الآتي " تحمي الدولة حقوق الإنسان وفق الشريعة الإسلامية " ؛

(b) the Basic Law of Government, promulgated in Royal Decree No. A/90 of 27 Sha'ban 1412 A.H., sets forth the general principles on which civil, political, economic, social and cultural rights are based.
(ب) النظام الأساسي للحكم الصادر بالمرسوم الملكي رقم (أ/90) بتاريخ 27/8/1412 ه، ويبين المبادئ العامة التي تقوم عليها الحقوق المدنية والسياسية والاجتماعية والاقتصادية والثقافية.

24. In accordance with article 49 of the Basic Law of Government: " Without prejudice to the provisions of article 53 hereof, the courts shall be competent to adjudicate in all disputes and offences. "
24- بموجب المادة 49 من النظام الأساسي للحكم التي نصها " مع مراعاة ما ورد في المادة 53 من هذا النظام تختص المحاكم في الفصل في جميع المنازعات والجرائم ... " .

the Basic Law of Government, which provides that the State shall ensure the security of its citizens and all persons residing in its territory and no one shall be arrested, detained or restricted in his freedom of action except as provided by law (art. 36).
- النظام الأساسي للحكم في المادة 36 التي تنص على أن " توفر الدولة الأمن لجميع مواطنيها والمقيمين على إقليمها، ولا يجوز تقييد تصرفات أحد أو توقيفه أو حبسه إلا بموجب أحكام النظام " .

This is contrary to Saudi domestic law, notably the article 36 of the Basic Law of Government which stipulates that " the State shall ensure the security of its citizens and all persons residing in its territory and no one shall be arrested, detained or restricted in his freedom of action except as provided by law. "
وهذا يخالف القانون المحلي السعودي، ولا سيما المادة 36 من النظام الأساسي للحكم الذي ينص على أن " تُوفر الدولة الأمن لجميع مواطنيها والمقيمين على إقليمها ولا يجوز تقييد تصرفات أحد أو توقيفه أو حبسه إلا بموجب أحكام النظام " .

(a) The Koran and the Sunna, from which governmental authority in the Kingdom of Saudi Arabia is derived and by which all the laws of the State are governed (article 7 of the Basic Law of Government), since they are the sole sources of legislation. They clearly advocate the protection of human dignity and rights and prohibit any infringement or violation thereof;
(أ) القرآن والسنة: ومنهما يستمد الحكم في المملكة العربية السعودية سلطته، وهما الحاكمان على جميع أنظمة الدولة (المادة 7 من النظام الأساسي للحكم) وكونهما المصدرين الوحيدين للتشريع وقد نصا بوضوح على حماية كرامة الإنسان وحفظ حقوقه وتحريم أي انتقاص لها أو الاعتداء عليها؛

27. With regard to procedures for the extradition of accused persons, article 42 of the Basic Law of Government stipulates: " The State shall grant the right of political asylum if the public interest so requires, the rules and procedures for the extradition of ordinary criminals being determined by international regulations and agreements. "
27- أما إجراءات تسليم المتهم فنصت عليها المادة 42 من النظام الأساسي للحكم: " تمنح الدولة حق اللجوء السياسي إذا اقتضت المصلحة العامة ذلك، وتحدد الأنظمة والاتفاقيات الدولية قواعد وإجراءات تسليم المجرمين العاديين " .

33. With regard to article 9 of the Convention ( " States Parties shall afford one another the greatest measure of assistance in connection with criminal proceedings brought in respect of any of the offences referred to in article 4 " ), in accordance with article 70 of the Basic Law of Government this is achieved through bilateral or regional agreements.
33- وبخصوص ما تضمنته المادة 9 من الاتفاقية من أنه " على كل دولة طرف أن تقدم إلى الدول الأطراف الأخرى أكبر قدر من المساعدة فيما يتعلق بالإجراءات الجنائية ... " ، فقد نصت المادة 70 من النظام الأساسي للحكم على أن تحقيق ذلك يتم عن طريق الاتفاقيات الثنائية أو الإقليمية.

35. Article 39 of the Basic Law of Government stipulates: " The information and publication media and all means of expression shall observe the rules of courtesy, respect the regulations of the State and help to educate the nation and consolidate its unity. Anything which is conducive to subversion or schism, prejudicial to the security or public relations of the State or detrimental to human dignity and rights shall be prohibited by law. "
35- وتنص المادة 39 من النظام الأساسي للحكم على أن " تلتزم وسائل الإعلام والنشر وجميع وسائل التعبير بالكلمة الطيبة وبأنظمة الدولة وتسهم في تثقيف الأمة ودعم وحدتها، ويحظر ما يؤدي إلى الفتنة أو الانقسام أو يمس بأمن الدولة وعلاقاتها العامة أو يسيء إلى كرامة الإنسان وحقوقه وتبين الأنظمة كيفية ذلك " .

39. the Basic Law of Government, under the terms of which: The majlis of the King and the majlis of the Crown Prince shall be open to every citizen and anyone who may have a complaint or grievance. Every individual shall have the right to address the public authorities regarding any matter of concern to him (art. 43).
39- النظام الأساسي للحكم في المادة 43 التي تنص على أن " مجلس الملك ومجلس ولي العهد مفتوحان لكل مواطــن ولكل مــن له شكـوى أو مظلمة، ومن حق كل فرد مخاطبة السلطات العامة فيما يعرض له من الشؤون ... " ، والمادة 47 منه التي سبق الإشارة إلى مضمونها.

3. AI stated that Saudi Arabia is a monarchy with all state powers invested in and confined to the king and the Al-Saud royal family and that the king enjoys absolute powers in the running of the affairs of the State and government institutions, as detailed in the Basic Law of Government (BLG) of 1992.
3- ذكرت منظمة العفو الدولية أن السعودية يحكمها نظام ملكي تتركز فيه كل سلطات الدولة وتنحصر في يد الملك وعائلة آل سعود المالكة وأن الملك يتمتع بسلطات مطلقة في إدارة شؤون الدولة ومؤسسات الحكم، على النحو المفصَّل في النظام الأساسي للحكم لعام 1992(5).

4. The Kingdom of Saudi Arabia protects human rights through its system of law and order in the light of its Constitution, consisting in the Holy Koran and the Sunna of the Prophet. The obligation to comply therewith is stipulated in article 7 of the Basic Law of Government, promulgated in Royal Decree No. A/90 of 27 Sha'ban 1412 A.H., which reads as follows:
4- والمملكة العربية السعودية من خلال نظامها العام تحمي حقوق الإنسان على ضوء دستورها: القرآن والسنة النبوية، وتضمن النظام الأساسي للحكم الصادر بالمرسوم رقم أ/90 بتاريخ 27/8/1412هالالتزام بذلك حيث نصت المادة 7 منه على الآتي: " يستمد الحكم في المملكة العربية السعودية سلطته من كتاب الله تعالى وسنة رسوله وهما الحاكمان على هذا النظام وجميع أنظمة الدولة " .

7. In the Kingdom, international regulations, treaties, conventions and privileges are promulgated in accordance with article 70 of the Basic Law of Government, which stipulates as follows: " International regulations, treaties, conventions and privileges shall be promulgated and amended by Royal Decree. "
7- تصدر الأنظمة والمعاهدات والاتفاقيات والامتيازات في المملكة على ضوء نص المادة 70 من النظام الأساسي للحكم حيث تنص تلك المادة على الآتي: " تصدر الأنظمة والمعاهدات والاتفاقيات الدولية والامتيازات ويتم تعديلها بموجب مراسيم ملكية... " .

(a) Article 36 of the Basic Law of Government stipulates that: " The State shall ensure the security of its citizens and all persons residing in its territory and no one shall be arrested, detained or restricted in his freedom of action except as provided by law. "
(أ) النظام الأساسي للحكم: في مادته 36 التي تنص على الآتي: " توفر الدولة الأمن لجميع مواطنيها والمقيمين على إقليمها ولا يجوز تقييد تصرفات أحد أو توقيفه أو حبسه إلا بموجب أحكام النظام ... " .

Equality of men and women before the law is a right established in the laws of the Kingdom and stipulated in article 47 of the Basic Law of Government: " The right of litigation shall be guaranteed equally for both citizens and residents in the Kingdom.
إن مساواة المرأة بالرجل أمام القانون حق مقرر في أنظمة المملكة كما نص على ذلك النظام الأساسي للحكم في المادة (47) " حق التقاضي مكفول بالتساوي للمواطنين والمقيمين في المملكة، ويبين النظام الإجراءات اللازمة لذلك " .

8. This Convention, having been ratified by royal decree, forms part of the domestic legislation, as a result of which its provisions can be invoked before the courts and the other judicial and administrative authorities in the Kingdom, as stipulated in article 70 of the Basic Law of Government ( " International regulations, treaties, conventions and privileges shall be promulgated and amended by Royal Decree " ).
8- فهذه الاتفاقية تعتبر نظاماً داخلياً إذا صدر مرسوم ملكي يقضي بالموافقة عليها ... وعليه يمكن الاحتجاج بأحكام الاتفاقية أمام المحاكم أو غيرها من السلطات القضائية أو الإدارية في المملكة ... كما نص على ذلك في المادة 70 من النظام الأساسي للحكم حيث تنص على الآتي: " تصدر الأنظمة والمعاهدات والاتفاقيات الدولية والامتيازات ويتم تعديلها بموجب مراسيم ملكية ... " .
