In identifying victims, the mission was guided by the definition of the Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law.

In the Basic Principles and Guidelines on the Right to a Remedy, the General Assembly recognized that it is through honouring the victims' right to benefit from remedies and reparation that the international community keeps faith with the plight of victims and survivors.

Attention is drawn to the Basic Principles and Guidelines on the Right to Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law, the Guiding Principles on Internal Displacement, and the Principles on housing and property restitution for refugees and displaced persons.
ويُسترعى الاهتمام إلى المبادئ الأساسية والمبادئ التوجيهية بشأن الحق في الانتصاف والجبر لضحايا الانتهاكات الجسيمة للقانون الدولي لحقوق الإنسان والانتهاكات الخطيرة للقانون الإنساني الدولي، وإلى المبادئ التوجيهية المتعلقة بالتشرد الداخلي والمبادئ المتعلقة برد المساكن والممتلكات إلى اللاجئين والمشردين.

Where evictions are justified, they should be undertaken in full compliance with the relevant provisions of international human rights law and according to the procedures underlined in general comment No. 7 and in the Basic Principles and Guidelines on development-based evictions and displacement.

Decides to adopt the Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Violations of International Human Rights and Humanitarian Law as follows:
تقرر اعتماد المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف والجبر لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي، وهذه المبادئ والخطوط هي:

The components of remedies and reparation were articulated through the Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law approved by the General Assembly in 2005.
وقد عُرضت مكونات سبل الانتصاف والتعويض من خلال المبادئ الأساسية والمبادئ التوجيهية بشأن الحق في الانتصاف والجبر لضحايا الانتهاكات الجسيمة للقانون الدولي لحقوق الإنسان والانتهاكات الخطيرة للقانون الإنساني الدولي التي أقرّتها الجمعية العامة في عام 2005.

However, the Committee acknowledges that, in the light of the Basic Principles and Guidelines on the Right to a Remedy and Reparations, victims' access to justice is increasingly being accepted as a relevant criterion applicable to investigations into alleged war crimes.

The Commission also adopted, after 15 years of elaboration, the Basic Principles and Guidelines on the right to a remedy and reparation for victims of gross violations of international human rights law and serious violations of international humanitarian law.

Essential to such efforts at the international level were the International Criminal Court and the Basic Principles and Guidelines on reparations annexed to Commission on Human Rights resolution 2005/35.

Two important guidance tools were produced: the Basic Principles and Guidelines on development-based evictions and displacement (2007) (A/HRC/4/18, annex I), and the guiding principles on security of tenure for the urban poor (2014) (see A/HRC/25/54).

In its resolution 1997/29, the Commission on Human Rights invited the Secretary-General to request all States to submit their views and comments on the note and revised text of the Basic Principles and Guidelines on the right to reparation for victims of [gross] violations of human rights and international humanitarian law contained in document E/CN.4/1997/104.
٢- ودعت لجنة حقوق الانسان، في قرارها ١٩٩٧/٢٩، اﻷمين العام ﻷن يطلب من جميع الدول آراءها وتعليقاتها حول المذكرة والمشروع المنقح للمبادئ اﻷساسية والخطوط التوجيهية بشأن حق ضحايا انتهاكات حقوق الانسان والقانون اﻹنساني الدولي ]الجسيمة[ في الجبر، الواردين في الوثيقة E/CN.4/1997/104.

After many years of debate, the Commission on Human Rights, at its sixty-first session, adopted the Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law(resolution 2005/35, annex).
