9-4 أما بخصوص تعليل صاحب البلاغ لعدم استئذانه في التماس مراجعة قضائية لقرار تقييم المخاطر الصادر في 21 كانون الثاني/يناير 2005 لأن محاميه في ذلك الوقت أخبره بأن سبل الانتصاف المحلية قد استُنفدت، فتلاحظ اللجنة أن صاحب البلاغ لم يفد بأن المحامي الذي كان يمثله عندئذ قد عينته له الدولة.
