In light of this, inter alia, the Committee concluded that the removal of the complainant to Azerbaijan in that case would not constitute a breach of article 3 of the Convention.

12- وتخلص لجنة مناهضة التعذيب، عملاً بأحكام الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن قرار الدولة الطرف بترحيل صاحب الشكوى إلى أذربيجان لا يشكل خرقاً لأحكام المادة 3 من الاتفاقية.

1.2 In accordance with article 22, paragraph 3, of the Convention, the Committee transmitted the communication to the State party on 13 June 2006, and requested it, under rule 108, paragraph 1, of the Committee's rules of procedure, not to expel the complainant to Azerbaijan while his complaint is under consideration by the Committee.
1-2 ووفقاً للفقرة 3 من المادة 22 من الاتفاقية، أحالت اللجنة البلاغ إلى الدولة الطرف في 13 حزيران/يونيه 2006، وطلبت منها، عملاً بالفقرة 1 من المادة 108 من النظام الداخلي للجنة، عدم طرد صاحب الشكوى إلى أذربيجان أثناء نظر اللجنة في شكواه.

1.2 On 9 October 2006, the Rapporteur for new complaints and interim measures requested the State party not to deport the complainant to Azerbaijan while his case is under consideration by the Committee, in accordance with rule 108, paragraph 1, of the Committee's rules of procedures.
1-2 وفي 9 تشرين الأول/أكتوبر 2006، طلب المقرر المعني بالشكاوى الجديدة والتدابير المؤقتة إلى الدولة الطرف عدم ترحيل صاحب الشكوى إلى أذربيجان طالما كانت قضيته محل نظر اللجنة، وفقاً للفقرة 1 من المادة 108 من نظامها الداخلي.

8.1 The issue before the Committee is whether the removal of the complainant to Azerbaijan would violate the State party's obligations under article 3 of the Convention not to expel or to return a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
8-1 إن المسألة المطروحة على اللجنة تتمثل في ما إذا كان إبعاد صاحب الشكوى إلى أذربيجان يشكل انتهاكاً لالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية بأن تمتنع عن طرد أي شخص أو إعادته إلى دولة أخرى إذا توافرت لديها أسباب جوهرية تدعو إلى الاعتقاد بأن هذا الشخص يواجه خطر التعرض للتعذيب.
