1.2 By note verbale of 22 September 2005, the Committee transmitted the complaint to the State party, together with a request, under rule 108, paragraph 1, of the Committee's rules of procedure from the Special Rapporteur on Interim Measures not to deport the complainant to Turkey, while her complaint is under consideration.

14- وإن لجنة مناهضة التعذيب، عملاً بأحكام الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، تخلص إلى أن قرار الدولة الطرف بإعادة صاحب الشكوى إلى تركيا لا يشكل خرقاً لأحكام المادة 3 من الاتفاقية.

1.2 On 31 January 2002, the Committee forwarded the complaint to the State party for comments and requested, under rule 108 of the Committee's rules of procedure, not to expel the complainant to Turkey while his complaint was under consideration by the Committee.

7.1 The issue before the Committee is whether removal of the complainant to Turkey would violate the State party's obligation under article 3 of the Convention not to expel or to return a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.

1.2 In accordance with article 22, paragraph 3, of the Convention, while transmitting the communication to the State party, on 29 September 2009, the Committee requested it, under rule 108, paragraph 1, of the Committee's rules of procedure, not to expel the complainant to Turkey while his communication was under consideration.
