In those cases, the courts and arbitral tribunals had to be certain that the conciliation proceedings had terminated and that the parties were entitled to commence those subsequent proceedings.
وفي تلك الحالات، لا بد للمحاكم وهيئات التحكيم من أن تكون على يقين من أن إجراءات التوفيق قد أنهيت وأن الطرفين يحق لهما بدء تلك الإجراءات اللاحقة.

It is uncertain furthermore whether the court can totally disregard the findings in the conciliation proceedings and make a determination on its own with regard to the facts necessary for the settlement of the dispute.
وليس من المؤكد فضلا عن ذلك ما إذا كان باستطاعة المحكمة تجاهل نتائج إجراءات التوفيق تماما وإصدار قرارها المستقل بشأن الوقائع الضرورية لتسوية النـزاع.

4. The provisions of paragraphs 1, 2 and 3 of this article apply whether or not the arbitral, judicial or similar proceedings relate to the dispute that is or was the subject matter of the conciliation proceedings.
4- تنطبق أحكام الفقرات 1 و 2 و 3 من هذه المادة سواء أكانت أم لم تكن الإجراءات التحكيمية أو القضائية أو الإجراءات المماثلة تتعلق بالنـزاع الذي يشكل، أو كان يشكل، موضوع إجراءات التوفيق.

In the view of his delegation, the proposed model rules deserved thorough and comprehensive consideration, keeping in mind the paramount principle of prior consent of the parties concerned at all stages of the conciliation proceedings.
ويرى الوفد الهندي أن التسوية المقترحة جديرة ببحث متعمق وضاف على أن يكون مفهوما أن مبدأ الموافقة المسبقة من اﻷطراف المعنية في جميع مراحل اجراءات التوفيق يجب أن يظل هو المبدأ الحاسم.

There was also a suggestion to deal with the issue of termination of the conciliation proceedings in article 24.
