50. Additional Protocol I also provides, in article 85, paragraph 4 that certain acts are grave breaches when committed wilfully and in violation of the conventions or Protocol, namely:
٥٠ - كما ينص البروتوكول الانساني اﻷول، في الفقرة ٤ من المادة ٨٥، على بعض اﻷفعال التي تعتبر انتهاكات جسيمة إذا ارتكبت عمدا بما يشكل خرقا للاتفاقيات أو البروتوكول، وهي:

“in situations of serious violations of the conventions or of this Protocol, the High Contracting Parties undertake to act, jointly or individually, in cooperation with the United Nations and in conformity with the United Nations Charter”.
" في حالة المخالفة الجسيمة للاتفاقيات أو لهذا البروتوكول، فإن اﻷطــراف السامية المتعاقدة تأخذ على عاتقهــا العمــل، جماعة أو فرادى، بالتعاون مع اﻷمم المتحدة ووفقا لميثاق اﻷمم المتحدة " .

Such cooperation takes place on an informal and ad hoc basis unless specifically required either in the provisions of the conventions or by the decisions of conferences of the Parties.

3. The Commission established under Article 90 is competent to, inter alia, inquire into any facts alleged to be a grave breach as defined in the Conventions and the Protocol or other serious violations of the conventions or of the Protocol (Geneva Conventions and first additional protocol).
3- إن اللجنة التي أُنشئت وفقاً للمادة 90 مؤهلة للقيام، في جملة أمور، بتقصي أية حقائق يزعم أنها تشكل انتهاكاً خطيراً بالمعنى المحدد في الاتفاقيات والبروتوكول، أو تقصي انتهاكات جدية أخرى للاتفاقيات أو البروتوكول (اتفاقيات جنيف والبروتوكول الإضافي الأول).

(b) Any such persons who do not benefit from more favourable treatment under the conventions or this Protocol shall be accorded the treatment provided by this article, whether or not the crimes of which they are accused constitute grave breaches of the conventions or of this Protocol.
(ب) ويحق لمثل هؤلاء الأشخاص ممن لا يفيدون بمعاملة أفضـل بمقتضى الاتفاقيات أو هذا الملحق " لبروتوكول " أن يعاملوا طبقاً لهذه المادة سواء كانت الجرائم التي اتهموا بها تشكل أم لا تشكل انتهاكات جسيمة للاتفاقيات أو لهذا الملحق.

Furthermore, when committed wilfully and in violation of the conventions or the Protocol, such acts are regarded as grave breaches under article 85 (4) (a) of Protocol Additional to the Geneva Conventions of 12 August 1949 and Relating to the Protection of Victims of International Armed Conflicts (Protocol I).
