Article 46 provided that the safety of the accused, victims and witnesses should be the responsibility of the Chamber. In his delegation's opinion, the Court and the Prosecutor should take responsibility for that.

On 26 February 2011, the Security Council adopted resolution 1970 (2011) in which it decided to refer the situation in Libya to the Prosecutor of the International Criminal Court and further decided that the Libyan authorities should cooperate fully and provide any necessary assistance to the Court and the Prosecutor.

2. If an accused wishes to raise such a defence, he must notify the Court and the Prosecutor a reasonable time prior to trial.
٢ - إذا ما رغب متهم في أن يثير مثل هذا الدفاع، فإنه يجب أن يخطر المحكمة والمدعي العام قبل بدء المحاكمة بوقت معقول.

23 - وذكر أن المحكمة ينبغي أن تكون متحررة من الضغط السياسي، وأن المحكمة والمدعي العام ينبغي لهما البت في المسائل على الأسس القانونية وحدها ولا ينبغي لهما أن يكونا أداتين سياسيتين لأية مصلحة أو قطاع.

In resolution 1593 (2005), the Council decided that the " Government of Sudan and all other parties to the conflict in Darfur shall cooperate fully with and provide any necessary assistance to the Court and the Prosecutor " (para. 2).
وقرر المجلس بالقرار 1593 (2005) " أن تتعاون حكومة السودان وجميع أطراف الصراع الأخرى في دارفور تعاونا كاملا مع المحكمة والمدعي العام وأن تقدم إليهما كل ما يلزم من مساعدة " (الفقرة 2).

أما بخصوص الحالة في دارفور بالسودان، فإن حكومة السودان وسائر الأطراف في النزاع ملزمة بالتعاون تعاونا تاما مع المحكمة والمدعي العام وتقديم المساعدة الضرورية لهما عملا بقرار مجلس الأمن 1593 (2005).

Mr. EL MASRY (Egypt), referring to article 43, thought that, to maintain a balance, the President of the Court and the Prosecutor should not have the same nationality or come from the same geographical group.

The Sudan, at an earlier stage, opted to cooperate with the Court, because paragraph 2 of Security Council resolution 1593 (2005) required the Government of the Sudan to cooperate fully with, and provide information and necessary assistance to, the Court and the Prosecutor.
وقد اختار السودان في مرحلة سابقة أن يتعاون مع المحكمة، باعتبار أن الفقرة 2 من قرار مجلس الأمن 1593 (2005) تقضي بأن تتعاون حكومة السودان على نحو كامل مع المحكمة والمدعي العام وأن تزودهما بالمعلومات وبالمساعدة اللازمة.

5 - يقرر أن تتعاون السلطات الليبية تعاوناً كاملا مع المحكمة ومع المدعي العام وتقدم لهما ما يلزمهما من مساعدةوفقاً لهذا عملا بمقتضيات هذا القرار، وإذ يسلم بأن الدول غير الأطراف في نظام روما الأساسي لا يقع عليها أي التزام بموجب ذلك النظام، يحث جميع الدول والمنظمات الإقليمية وسائر المنظمات الدولية المهتمة بالأمر على التعاون التام مع المحكمة والمدعي العام؛
