(b) The State to which the person is transferred shall return the person to the custody of the State from which the person was transferred [as soon as circumstances permit]The expression “as soon as circumstances permit” was considered by some delegations to be ambiguous and, therefore, it was proposed to delete it.
)ب( تقوم الدولة التي ينقل إليها الشخص بإعادته إلى احتجاز الدولة التي نقل منها ]حالما تسمح الظروف بذلك[رأى بعض الوفود أن عبارة " حالما تسمح الظروف بذلك " تنطوي على التباس ، ولذلك اقترح حذفها .

(d) The person transferred shall receive credit for service of the sentence being served in the State from which he was transferred for the time spent in the custody of the State to which he was transferred.
(د) تحتسب للشخص المنقول المدة التي قضاها قيد التحفظ لدى الدولة التي نُقل إليها، على أنها من مدة العقوبة المنفَّذة عليه في الدولة التي نُقل منها.

Most, if not all, countries have explicit legal prohibitions on custodial violence, including torture, rape, force, coercion, threats and any form of physical violence or abuse of an individual in the custody of the State.
٣٤١- وتحظر معظم البلدان، إن لم يكن جميعها، حظراً قانونياً صريحاً ممارسة العنف أثناء الحراسة بما في ذلك التعذيب والاغتصاب واستعمال القوة واﻹكراه والتهديدات وأي شكل من أشكال العنف البدني أو إساءة معاملة أي شخص يوجد في حراسة الدولة.
