2- ويجب أن تدعو لوائح الاشتراء إلى أن تتخذ الجهة المشترية تدابير سريعة بمقتضى هذه المادة بحيث يمكن للمورِّدين أو المقاولين أخذ الإيضاحات والتعديلات في الحسبان في توقيت يسبق الموعد النهائي لتقديم العروض.

(b) Order the suspension of the procurement proceedings [or the performance of a procurement contract or the operation of a framework agreement, as the case may be] where an application is received after the deadline for presenting submissions and where no standstill period has been applied;
(ب) تأمر بتعليق إجراءات الاشتراء [أو تنفيذ عقد الاشتراء أو إعمال اتفاق إطاري، حسب الحالة]، في حال تلقي طلب بعد انقضاء الموعد النهائي لتقديم العروض وإذا لم تُطبَّق أيُّ فترة توقّف؛

We propose that the minimum time prior to the deadline for presenting submissions during which modifications may be introduced to the solicitation documents by the procuring entity should be defined since the indeterminacy of this time period could seriously hamper the work of the procuring entity and give rise to unfounded challenges of the entity's further actions, which could in turn prolong the procurement proceedings without justification.
ونقترح أن تُحدّد الفترة الزمنية الدنيا قبل الموعد النهائي لتقديم العروض التي يجوز خلالها للجهة المشترية إدخال تعديلات على وثائق الالتماس، لأن عدم تحديد هذه الفترة الزمنية يمكن أن يعيق على نحو خطير عمل الجهة المشترية وأن تترتب عليه طعون لا أساس لها في الإجراءات الأخرى التي تتخذها الجهة المشترية، ممّا قد يؤدي بدوره إلى إطالة أمد إجراءات الاشتراء دون مبرر.

Prompt communication of clarifications and modifications also enables suppliers or contractors to exercise their right, for example under article 40(3), to modify or withdraw their tenders prior to the deadline for presenting submissions, unless that right has been removed in the solicitation documents.
كما يمكِّن الإبلاغ السريع بالإيضاحات والتعديلات المورِّدين أو المقاولين من ممارسة حقهم، بمقتضى الفقرة 40 (3) مثلا، في تعديل عروضهم أو سحبها قبل الموعد النهائي لتقديم العروض ما لم يُلْغَ هذا الحق في وثائق الالتماس.

As article 40 (3), paragraph (2)(d), reflects that the procuring entity may avail itself, by way of a stipulation in the solicitation documents, of an exception to the general rule that withdrawal or modification of a tender prior to the deadline for presenting submissions is not subject to forfeiture of the tender security.
وعلى غرار الفقرة (3) من المادة 40، تبيِّن الفقرة (2) (د) أنَّ للجهة المشترية أن تستفيد، من خلال النص على ذلك في وثائق الالتماس، من استثناء من القاعدة العامة التي تقضي بأنَّ سحب العطاء أو تعديله قبل الموعد النهائي لتقديم العروض ليس خاضعا لإلغاء ضمانة العطاء.()

(b) The [name of the independent body] shall order the suspension of the procurement proceedings (or the performance of a procurement contract or the operation of a framework agreement, as the case may be)9 where an application or an appeal is received after the deadline for presenting submissions and where no standstill period has been applied;
(ب) تأمر [اسم الهيئة المستقلة] بتعليق إجراءات الاشتراء (أو تنفيذ عقد الاشتراء أو إعمال اتفاق إطاري، حسب الحالة)،(9) في حال تلقي طلب أو استئناف بعد انقضاء الموعد النهائي لتقديم العروض وإذا لم تُطبَّق أيُّ فترة توقّف؛

The reference, however, is not intended to encourage such a practice, in particular since the requirement of local confirmation could constitute an obstacle to participation by foreign suppliers and contractors in procurement proceedings (e.g., difficulties in obtaining the local confirmation prior to the deadline for presenting submissions and added costs for foreign suppliers and contractors).
غير أنَّ ورود هذه الإشارة لا يقصد به التشجيع على اتباع تلك الممارسة، لا سيما وأنَّ اشتراط التأكيد المحلي قد يكون عقبة تعيق مشاركة المورِّدين والمقاولين الأجانب في إجراءات الاشتراء (مثلا الصعوبات في الحصول على التأكيد المحلي قبل الموعد النهائي لتقديم العروض وما يترتّب على ذلك من تكاليف إضافية يتكبدها المورِّدون والمقاولون الأجانب).
