The State party adds that the author considers that the law-enforcement authorities have either failed or refused to carry out an effective inquiry into the circumstances of the death of her son, and they have failed to discover those responsible, whereas the courts have de facto failed in their duty to administrate justice.

5.5 In conclusion, the author reiterates that due to the failure to provide a plausible explanation for the death of her son by means of an independent and effective investigation, the Committee should find that the death of the victim was an arbitrary killing.
5-5 وختاماً، تكرر صاحبة البلاغ أنه بالنظر إلى عدم التمكن من تقديم تفسير مقبول لوفاة ابنها عن طريق تحقيق مستقل وفعال، ينبغي أن تتوصل اللجنة إلى أن وفاة الضحية كان قتلاً تعسفياً.

The Committee, however, observed that other than her initial complaint to the police, the author did not make any other attempt to contest the alleged ineffectiveness of the investigation apart from oral inquiries, the latest of which she had made a year after the death of her son.

2.5 The author further contends that as a result of her remarriage and emigration to New Zealand, in 1997, and her deteriorated mental health condition, she was both mentally and physically unable to further follow up on the investigation into the death of her son in Latvia.

235. In case No. 1548/2007 (Kholodova v. Russian Federation), involving the violation of article 2, paragraph 3 (a) in conjunction with article 6, paragraph 1 of the Covenant, the State party was requested to provide the author with an effective remedy and take all possible measures to ensure that those responsible for the death of her son are brought to justice.
235- وفي القضية رقم 1548/2007 (خولودوفا ضد الاتحاد الروسي)، التي انطوت على انتهاك للفقرة 3(أ) من المادة 2 بالاقتران مع الفقرة 1 من المادة 6 من العهد()، طُلب إلى الدولة الطرف أن تتيح لصاحبة البلاغ سبيل انتصاف فعالاً، وأن تتخذ كافة التدابير الممكنة لضمان تقديم المسؤولين عن وفاة ابنها إلى العدالة.

The State party maintains that the present case may not be compared to such cases for the following reasons: the death of her son was not caused by a criminal activity; the State authorities that were involved in the investigation " may not be blamed " for his death; the author failed to complain about the quality of the investigation to the Prosecutor's office; and she did not inform the State authorities of her change of residence.
وتؤكد الدولة الطرف أن القضية الحالية لا يمكن مقارنتها بتلك القضايا للأسباب التالية: لم تكن وفاة ابنها ناجمة عن نشاط إجرامي؛ ولا يمكن " إلقاء اللوم " على السلطات الحكومية التي شاركت في التحقيق في سبب وفاته؛ ولم تقدم صاحبة البلاغ شكوى بشأن نوعية التحقيق إلى مكتب المدعي العام؛ ولم تبلغ السلطات الحكومية بتغيير محل إقامتها.

12. In accordance with article 2, paragraph 3 (a), of the Covenant, the State party is under an obligation to provide the author with an effective remedy, and take all possible measures to ensure the those responsible for the death of her son are brought to justice.
12- ووفقاً للفقرة 3(أ) من المادة 2 من العهد، فإن الدولة الطرف ملزمة بتوفير سبيل انتصاف فعال لصاحب البلاغ، واتخاذ جميع التدابير الممكنة لضمان محاكمة المسؤولين عن مقتل ابنها.
