Recalling further the advisory opinion rendered on 9 July 2004 by the International Court of Justice on the Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory, and recalling in particular the Court's reply to the question put forth by the General Assembly in resolution ES10/14 of 8 December 2003, as set forth in the dispositif of the advisory opinion,
وإذ تشير كذلك إلى الفتوى التي أصدرتها محكمة العدل الدولية في 9 تموز/يوليه 2004 بشأن الآثار القانونية الناشئة عن تشييد جدار في الأرض الفلسطينية المحتلة(19)، وإذ تشير على وجـــــه الخصوص إلى رد المحكمة على السؤال الـــذي طرحته الجمعية العامة في القرار دإط - 10/14 المؤرخ 8 كانون الأول/ديسمبر 2003، على النحو المبين في منطوق الفتوى(20)،

I proceed now to make some comments on the individual paragraphs of Part 2 of the dispositif.
وأنتقل اﻵن ﻹبداء بعض التعليقات على فرادى الفقرات في الجزء ٢ من المنطوق.

I have also voted in favour of paragraphs 2A, 2B, 2C, 2D and 2F of the dispositif.
وقد صوﱠتﱡ أيضا مؤيدة الفقرات ٢ ألف، و ٢ باء، و ٢ جيم، و ٢ دال، و ٢ واو، من المنطوق.

36. The latter part of the dispositif deals with the legal consequences of the findings made by the Court.
36 - ويتناول الجزء الأخير من المنطوق الآثار القانونية المترتبة على الاستنتاجات التي خلصت إليها المحكمة.

This legally authoritative dictum, which has my full support, was confined to the reasoning. The legal consequences that flow for all States from measures which severely impede the exercise by the Palestinians of an erga omnes right, should, in my view, have been included in the dispositif.
بيد أن هذا المنطوق المستند إلى مرجعية قانونية، وهو يحوز تأييدي الكامل، جاء مقتصرا على الحيثيات المنطقية، وكان ينبغي أن تدرج في منطوق الحكم النتائج القانونية التي تترتب بالنسبة لجميع الدول عن التدابير التي تعوق بشدة ممارسة الفلسطينيين الحق المترتب إزاء الكافة.

On the contrary, as the dispositif in effect acknowledges, while they might " generally " do so, in specific cases they might not.
فهي، على العكس، وكما يعترف المنطوق في الواقع، بينما يمكن أن تكون كذلك " بصورة عامة " ربما لا تكون كذلك في حالات محددة.

Speaking for myself, I would have viewed this unquestionable proposition as a preliminary recital, rather than as part of the dispositif.
أتحدث أصالة عن نفسي فأقول إنه كان ينبغي النظر الى هذا الافتراض الذي لا نزاع فيه كحيثية أولية بدلا من كونه جزءا من المنطوق.

26. There is a further reason why I have been unable to vote for paragraph 2E of the dispositif.
٢٦ - وهناك سبب آخر لعدم استطاعتي التصويت مؤيدة الفقرة ٢ هاء من المنطوق.

27. The meaning of the second sentence of paragraph 2E of the dispositif, and thus what the two sentences of paragraph 2E of the dispositif mean when taken together, is unclear.
٢٧ - إن معنى الجملة الثانية من الفقرة ٢ هاء من المنطوق، ومن ثم معنى الجملتين الواردتين في الفقرة ٢ هاء من المنطوق عند أخذهما معا، ليس واضحا.

It evidences a measure of uncertainty in a case in which the tension between State practice and legal principle is unparalleled. It concludes, in Paragraph 2E of the dispositif, that,
وهو يظهر قدرا من الريب في قضية لا مثيل لما فيها من توتر بين ممارسة الدول والمبدأ القانوني؛ ويخلص في الفقرة ٢ - هاء من المنطوق الى أنه

35. For all of these reasons, I am unable to see why the Court resorts to the answer it does in the second part of paragraph 2E of the dispositif.
٣٥ - ولكل هذه اﻷسباب، ليس بمقدوري أن أفهم لماذا تلجأ المحكمة إلى الجواب الذي قدمته في الجزء الثاني من الفقرة ٢ هاء من المنطوق.

20. My vote in favour of subparagraph (2) of the dispositif has thus been made with considerable hesitation.
20 - وبناء على ذلك صوت لصالح الفقرة الفرعية (2) من المنطوق بتردد شديد.

21. The way subparagraph (3) (A) of the dispositif is formulated does not separate out the various grounds that the Court relied on in reaching its conclusions.
21 - والطريقة التي صيغت بها الفقرة الفرعية (3) (ألف) من المنطوق لا تفصّل مختلف الأسباب التي استندت إليها المحكمة في التوصل إلى استنتاجاتها.

My negative votes with regard to the remaining items of the dispositif should not be seen as reflecting my view that the construction of the wall by Israel on the Occupied Palestinian Territory does not raise serious questions as a matter of international law.
وصوتي المعارض فيما يتعلق بالبنود المتبقية من المنطوق لا ينبغي النظر إليها باعتبارها انعكاسا لرأي بأن تشييد إسرائيل للجدار في الأرض الفلسطينية المحتلة لا يثير تساؤلات جدية باعتباره مسألة تتعلق بالقانون الدولي.

However, I find myself obliged to explain the reasons which have led me to vote in favour of paragraph 2E of the dispositif, which carries the implication of the indecisiveness of the Court and indirectly admits the existence of a " grey area " in the present regulation of the matter.
غير أني أجد نفسي ملزما بشرح اﻷسباب التي أدت بي الى التصويت بتأييد الفقرة ٢ هاء من المنطوق التي تنطوي على تردد من جانب المحكمة وتسلﱢم على نحو غير مباشر بوجود " منطقة غير واضحة " في التنظيم الحالي للمسألة.

It is submitted that this finding should have been reflected in the dispositif with an affirmation that the Occupied Palestinian Territory cannot be annexed.
ويجدر القول بأن هذا الاستنتاج كان ينبغي أن ينعكس في منطوق الحكم مشفوعا بالتأكيد بأن الأرض الفلسطينية المحتلة لا يمكن ضمها.
