– That at the time when the attack was launched, the buildings, material, medical units and transport, and personnel using the distinctive emblems of the Geneva Conventions enjoyed protection under international law and displayed the distinctive signs or signals which would enable the accused to identify them;
- أن تكون المباني والمواد والوحدات والمركبات الطبية واﻷفراد من مستعملي الشعارات المميزة المبيﱠنة في اتفاقيات جنيف، يتمتعون عند وقوع الهجوم، بالحماية طبقا للقانون الدولي ويحملون العلامات واﻹشارات المميزة التي تساعد المتهم على التعرف عليهم.

– That at the time when the attack was launched, the buildings, material, medical units and transport, and personnel using the distinctive emblems of the Geneva Conventions were not subject to any circumstances that would end the protection due to them under international law;
- أن تكون المباني والمواد والوحدات والمركبات الطبية واﻷفراد من مستعملي الشعارات المميزة المبيﱠنة في اتفاقيات جنيف، لم يصدر عنهم عند وقوع الهجوم ما يرفع عنهم الحماية الواجب تقديمها لهم طبقا للقانون الدولي.

– That for that purpose the accused launched an attack consisting of an offensive or defensive act of violence against buildings, material, medical units and transport, including hospital ships, medical vessels and medical aircraft, and against personnel using the distinctive emblems of the Geneva Conventions, although without causing harm;
