The termination of or the withdrawal from a treaty, or the suspension of its operation, as a consequence of an armed conflict, shall not impair in any way the duty of any State to fulfil any obligation embodied in the treaty to which it would be subject under international law independently of that treaty.
إن إنهاء معاهدة أو الانسحاب منها أو تعليق نفاذها، نتيجة لنزاع مسلح، لا ينتقص بأي حال من واجب أي دولة أن تفي بأي التزام تتضمنه المعاهدة وتكون ملزمة به بموجب القانـون الدولي بمعزل عن تلك المعاهدة.

97. Draft article 9, which has its roots in article 43 of the 1969 Vienna Convention, provides that the termination of or the withdrawal from a treaty, or the suspension of its operation, as a consequence of an armed conflict, shall not impair in any way the duty of any State to fulfil any obligation embodied in the treaty to which it would be subject under international law independently of that treaty.
97 - ينص مشروع المادة 9، المقتبس من المادة 43 من اتفاقية قانون المعاهدات، على أن إنهاء معاهدة أو الانسحاب منها أو تعليق نفاذها، نتيجة لنزاع مسلح، لا يحد بأي حال من واجب أي دولة من واجب الوفاء بأي التزام تتضمنه المعاهدة وتكون ملزمة به بموجب القانـون الدولي بمعزل عن تلك المعاهدة.
