Such electronic signature shall identify the signatory in relation to the electronic transport record and indicate the carrier's authorization of the electronic transport record. Article 41.

The contract particulars in the transport document or the electronic transport record referred to in article 37 shall also include:
2- يُدرج أيضا في تفاصيل العقد الواردة في مستند النقل أو سجل النقل الإلكتروني المشار إليه في المادة ٣7:

1. The absence or inaccuracy of one or more of the contract particulars referred to in article 38, paragraphs 1 or 2, does not of itself affect the legal character or validity of the transport document or of the electronic transport record.
1- لا يمسُّ إغفال أو عدم صحة واحد أو أكثر من تفاصيـل العقـد المشـار إليها في الفقرتين 1 أو 2 من المادة ٣8، في حد ذاته، بالطابع القانوني لمستند النقل أو سجل النقل الإلكتروني أو بصحة أي منهما.

(b) Any additional inspection that the carrier or a performing party actually performs before issuing the transport document or the electronic transport record.
(ب) وأي تفقّد إضافي يقوم به الناقل أو الطرف المنفّذ فعليا قبل إصدار مستند النقل أو سجل النقل الإلكتروني.

It was also suggested that the words " that its name appears on the transport document or the electronic transport record as the shipper " should be inserted after the word " accepts " , in order to narrow the interpretation of the draft provision.
واقتُرح أيضا إدخال الجملة " أن يظهر اسمه على مستند النقل أو سجل النقل الإلكتروني على أنه هو الشاحن " بعد العبارة " قَبِلَ " ، بغية تضييق تفسير مشروع الحكم.

" 2 bis. The contract particulars in the transport document or the electronic transport record referred to in article 37 shall furthermore include:
" 2 مكرراً- تشمل تفاصيل العقد الواردة في مستند النقل أو سجل النقل الإلكتروني المشار إليهما في المادة 37، علاوة على ذلك، ما يلي:

" 2. If the negotiable transport document or the negotiable electronic transport record states that the goods may be delivered without the surrender of the transport document or the electronic transport record, the following rule applies:

" Electronic transport record " means information in one or more messages issued by electronic communication under a contract of carriage by a carrier, including information logically associated with the electronic transport record by attachments or otherwise linked to the electronic transport record contemporaneously with or subsequent to its issue by the carrier, so as to become part of the electronic transport record, that:
18 - " سجل النقل الإلكتروني " يعني المعلومات الواردة في رسالة واحدة أو أكثر يصدرها الناقل بوسيلة اتصال إلكترونية بمقتضى عقد النقل، بما فيها المعلومات المرتبطة منطقيا بسجل النقل الإلكتروني بواسطة مرفقات أو الموصولة بطريقة أخرى بسجل النقل الإلكتروني إبان أو عقب إصداره من جانب الناقل بحيث تصبح جزءا من سجل النقل الإلكتروني، والتي:

It was also suggested that draft article 1 (f)(ii) should specifically indicate to whom the electronic transport record would be transferable.
واقتُرح أيضا أن يشير مشروع المادة 1 (و) `2` بالتحديد إلى من سيكون سجل النقل الالكتروني قابلا للإحالة إليه.
