247. The Committee notes that the persistence of stereotypical and patriarchal attitudes to the role of women in the family and the community prevents the enjoyment by women of human rights and denies them the opportunity to participate fully in national development.
247- تلاحظ اللجنة أن استمرار وجود السلوكيات القائمة على القوالب النمطية والمواقف السلطوية فيما يتعلق بدور المرأة في الأسرة والمجتمع يعيق تمتع المرأة بحقوق الإنسان ويحرمها فرصة المشاركة في التنمية الوطنية مشاركة كاملة.

6.3 The State party submits that it is aware that the Committee has emphasized in its general recommendation No. 19 that gender-based violence is a form of discrimination that can impair or nullify the enjoyment by women of human rights and fundamental freedoms, such as the right to life, the right to security of the person and the right not to be subjected to torture or to cruel, inhuman or degrading treatment or punishment.
6-3 وتدفع الدولة الطرف بأنها تدرك أن اللجنة أكدت في توصيتها العامة رقم 19 أن العنف القائم على نوع الجنس ضرب من ضروب التمييز يمكن أن يعوق أو يبطل تمتع النساء بحقوق الإنسان والحريات الأساسية، كالحق في الحياة والحق في الأمن والحق في عدم التعرض للتعذيب أو للمعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة.

Welcoming the adoption by the General Assembly, in its resolution 48/104 of 20 December 1993, of the Declaration on the Elimination of Violence against Women, which recognizes that violence against women both violates and impairs or nullifies the enjoyment by women of human rights and fundamental freedoms, and expresses concern about the longstanding failure to protect and promote these rights and freedoms in relation to violence against women,
وإذ ترحب باعتماد الجمعية العامة، في قرارها 48/104 المؤرخ 20 كانون الأول/ديسمبر 1993، إعلان القضاء على العنف ضد المرأة، الذي تُسلِّم فيه بأن العنف ضد المرأة ينتهك ويعوق أو يلغي تمتع المرأة بحقوق الإنسان والحريات الأساسية، وتُعرب فيه عن قلقها إزاء الإخفاق منذ أمد بعيد في حماية وتعزيز تلك الحقوق والحريات فيما يتصل بالعنف ضد المرأة،

The Committee reiterates that " gender-based violence, which impairs or nullifies the enjoyment by women of human rights and fundamental freedoms " , including the " right not to be subject to torture or to cruel, inhuman or degrading treatment or punishment " , constitutes discrimination within the meaning of article 1 of the Convention (para. 7 (b) of the recommendation).
وتعيد اللجنة التأكيد على أن " العنف القائم على أساس نوع الجنس الذي ينال من تمتع المرأة بحقوق الإنسان والحريات الأساسية ... أو يبطل تمتعها بتلك الحقوق والحريات " ، بما في ذلك " الحق في عدم التعرض للتعذيب أو للمعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة " ، يشكّل تمييزا بحسب مدلول المادة 1 من الاتفاقية (الفقرة 7 (ب) من التوصية).

In that context, the Committee recalls that in its general recommendation No. 19 (1992), gender-based violence against women is defined as impairing or nullifying the enjoyment by women of human rights and fundamental freedoms, and constitutes discrimination within the meaning of article 1 of the Convention, whether perpetrated by a State official or a private citizen, in public or private life.
وتذكّر اللجنة في هذا السياق بأن العنف القائم على نوع الجنس والموجه ضد النساء قد عُرّف في توصيتها العامة رقم 19(1992) بوصفه عملاً يعيق تمتع النساء بحقوق الإنسان والحريات الأساسية ويلغيه، ويشكل تمييزاً وفقاً للمفهوم الوارد في المادة 1 من الاتفاقية سواء ارتُكب من جانب موظف حكومي أو مواطن عادي وفي الحياة العامة أو الخاصة.
