٣٢- إن حالة الطوارئ التي أعلنت كانت تتطلبها مقتضيات الوضع.

The last sentence expressed the notion that, even in relation to those rights from which it was fully legitimate to derogate in times of emergency, States parties were under a general obligation to limit derogations to the exigencies of the situation.
وتعبّر الجملة الأخيرة عن فكرة أنه حتى فيما يتعلق بتلك الحقوق التي يعتبر تقييدها أمراً مشروعاً كلّياً في حالات الطوارئ، فإن الدول الأطراف تتحمل التزاماً عاماً بحصر التقييدات على مقتضيات الوضع القائم.

However, having regard to the exigencies of the situation obtaining in the country at present, the Union of Myanmar states as follows:
ولكن بالنظر إلى مقتضيات الحالة السائدة في البلد في الوقت الحالي، تسجل حكومة ميانمار ما يلي:

وإضافة إلى ذلك، فإن مجرد كون جواز عدم التقيد بحكم محدد مبرراً في حد ذاته بمتطلبات الوضع لا يبطل اشتراط إثبات أن التدابير المحددة المتخذة بموجب جواز عدم التقيد استوجبتها أيضاً متطلبات الوضع.

Such measures should be taken only to the extent strictly required by the exigencies of the situation and should not be discriminatory.

4. A fundamental requirement for any measures derogating from the Covenant, as set forth in article 4, paragraph 1, is that such measures are limited to the extent strictly required by the exigencies of the situation.

The legal obligation to narrow down all derogations to those strictly required by the exigencies of the situation establishes both for States parties and for the Committee a duty to conduct a careful analysis under each article of the Covenant based on an objective assessment of the actual situation.

22. As stated before, the derogating State may take only such measures as strictly required by the exigencies of the situation.
22 - وكما تقدم ذكره لا يجوز للدولة التي تتخذ تدابير عدم التقيد أن تتخذ هذه التدابير إلا في أضيق الحدود التي تتطلبها مقتضيات الوضع.

Mr. KRETZMER said there seemed to be some confusion between the two issues of when a State party could resort to a state of emergency under article 4.1 and what measures were required by the exigencies of the situation.
