8.7 In the light of the above, the State party contends that the facts of the case do not reveal any violation of articles 16, 17, 23, 24 or 26 of the Covenant.
٨-٧ وفي ضوء ما جاء أعلاه، تحاجج الدولة الطرف بأن وقائع القضية لا تكشف عن وجود اي انتهاك للمواد ٦١ و٧١ و٣٢ و٤٢ و٦٢ من العهد.

5.1 By submission of 8 December 1992, the State party argues that the author's communication is unsubstantiated, since the facts of the case do not reveal a violation of article 26 of the Covenant.
٥-١ تقول الدولة الطرف، في رسالتها المؤرخة في ٨ كانون اﻷول/ديسمبر ٢٩٩١، إن بلاغ صاحبة البلاغ يفتقر إلى الدليل ﻷن وقائع القضية لا تكشف عن حدوث انتهاك للمادة ٦٢ من العهد.

4.16 As regards the author's claim under article 16 of the Covenant, the State party argues that the facts of the case do not raise an issue under this article, since the author exercised the same legal rights as any other individual brought before a court in Australia.
٤-١٦ وفيما يتعلق بادعاء صاحب البلاغ بمقتضى المادة ١٦ من العهد، تدفع الدولة الطرف بأن وقائع القضية لا تثير مشكلة طبقا لهذه المادة، بالنظر إلى أن صاحب البلاغ قد مارس نفس الحقوق القانونية مثل أي فرد آخر عُرض على محكمة في استراليا.
