The Panel further finds that the estimate of the ratio of equities to bonds invested in the FGF at the end of each financial year, derived as set out in paragraph 73 above provides sufficient evidence of those ratios and has adopted each such ratio for the purposes of its review.

The Panel finds that the investment returns earned on the balance of the FGF that remained after the liquidations closely tracked the investment returns using the world market indices for the period 1990 to 2001.[cxlv]
468- ويرى الفريق أن عائدات الاستثمار المكتسبة على رصيد صندوق الأجيال القادمة الذي بقي بعد عمليات التصفية تعقبت عن كثب عائدات الاستثمار باستخدام مؤشرات السوق العالمية للفترة من 1990 إلى 2001(145).

KIA also states that the investment income that accrued on the FGF holdings managed internally by KIO was not re-invested in the FGF during each year of the liquidation period.
71- كما تذكر الهيئة أن الإيرادات الاستثمارية المتراكمة المتأتية من موجودات صندوق الأجيال القادمة المدارة داخلياً من جانب المكتب الكويتي للاستثمار، لم يعد استثمارها في هذا الصندوق كل عام من أعوام التصفية.

In the working example, the Government (through a funding entity, which was also part of the Government) raised the sum of 500, on a date after 2 August 1990, by liquidating assets from the FGF.
125- في المثال العملي، عمدت الحكومة, في تاريخ يقع بعد 2 آب/أغسطس 1990, (وعبر كيان ممول، يعد كذلك جزءاً من الحكومة) إلى جمع مبلغ 500، وذلك من خلال تصفية أصول التي يمتلكها صندوق الأجيال القادمة.

Having considered all the evidence before it, the Panel is satisfied that, had there been no liquidations, the percentage investment returns earned on the FGF would not have been significantly different from those in fact earned on the remaining portfolio.
469- واقتنع الفريق، بعد الاطلاع على جميع الأدلة المعروضة عليه، بأنه لو لم تكن هناك عمليات تصفية، لما كانت نسبة العائدات المكتسبة على صندوق الأجيال القادمة مختلفة جداً عن العائدات المكتسبة فعلاً على بقية الحافظة.

KIA was responsible for the management, in the name and account of the Government of Kuwait, of Kuwait’s main reserves, comprising its Future Generations Fund (the “FGF”), its General Reserve Fund (“GRF”)[xvi] and other funds, and of a portfolio of commercial and residential real estate.
والهيئة مسؤولة عن إدارة الاحتياطيات الرئيسية الكويتية، باسم ولحساب حكومة الكويت، وهذه الاحتياطيات تضم صندوق الأجيال القادمة وصندوق الاحتياطي العام(16) وأموال أخرى، وإدارة الحافظة المالية للعقارات التجارية والسكنية.

KIA asserts that it sold assets from the FGF (“Liquidated Assets”, giving rise via “liquidations” to “Amounts Liquidated”) and borrowed money on the international money markets (via “borrowings”, giving rise to “Funds Borrowed”) to provide funds for the reconstruction of Kuwait’s infrastructure and to support the Kuwaiti people.
وتؤكد أنها قامت ببيع أصول من صندوق الأجيال القادمة ( " أصول مصفاة " ، نشأت عنها عبر " عمليات التصفية " " المبالغ المصفاة " ) واقتراض أموال من الأسواق المالية الدولية (عبر " عمليات الاقتراض " فنشأت " القروض " )، لتوفير الأموال اللازمة لإعمار البنية التحتية للكويت ولدعم شعبها.

The Panel recalls that, prior to Iraq’s invasion and occupation of Kuwait, investment income was re-invested in the FGF, but notes that the calculation of the Portfolio Loss does not include the lost investment returns on income that would have been reinvested and would have accrued further yields, had it not been for Iraq’s invasion.
74- ويشير الفريق إلى أن إيرادات الاستثمار أُعيد استثمارها في صندوق الأجيال القادمة قبل غزو العراق للكويت واحتلاله لها، بيد أنه يلاحظ أن تقدير خسائر حوافظ الاستثمار لا يُدرج عوائد الاستثمار الفائتة في الإيرادات التي كان من الممكن إعادة استثمارها وكانت ستسمح بتراكم المزيد من العائدات، لولا الغزو العراقي.

It is only by examining the application of the Funds Raised that it can be seen that the Funds Raised were not re-invested in assets capable of generating investment returns equivalent to those that would have been earned had they remained in the FGF.
بل إن دراسة توظيف الأموال المجمعة هي التي تمكن من تبيُّن ما إذا كانت الأموال المجمعة لم يُعَدْ استثمارها في أصول قادرة على در عائدات استثمارية تعادل تلك التي كانت ستكتسب لو أنها بقيت في " صندوق الأجيال القادمة " .

KIA seeks compensation in the amount of USD 54,778,087,423 for what KIA terms “loss of use of the investments”, “opportunity losses” or “loss of profits”, that it would have received on the assets that were liquidated from the FGF from 2 August 1990 until 31 December 1993.
68- وتلتمس الهيئة مبلغ 423 087 778 54 دولاراً من دولارات الولايات المتحدة تعويضاً عما تصِفهُ " خسائر استخدام الاستثمارات " أو " الفرص الضائعة " أو " الكسب الفائت " ، وهي مبالغ كانت ستتلقاها على الأصول التي تمت تصفيتها من صندوق الأجيال القادمة في الفترة من 2 آب/أغسطس 1990 حتى 31 كانون الأول/ديسمبر 1993.

In its statement of claim, KIA asserted that between August 1990 and the end of 1993,[xx] to which period the Panel will refer as the “liquidation period”, it liquidated USD 50,679,700,000 from the FGF.[xxi] The total annual amount of liquidations, as per the statement of claim, arose as follows:
62- أكدت الهيئة الكويتية العامة للاستثمار في بيان مطالبتها أنها قامت في الفترة بين آب/أغسطس 1990 ونهاية عام 1993(20)، التي سيشير إليها الفريق على أنها " فترة التصفية " ، بتصفية ما قيمته 000 700 679 50 دولاراً من دولارات الولايات المتحدة من أصول صندوق الأجيال القادمة(21). وأن المبالغ الإجمالية التي جرت تصفيتها سنوياً بحسب بيان المطالبة هي كما يلي:

With respect to the Portfolio Loss, Kuwait further asserts that, prior to Iraq’s invasion and occupation of Kuwait, it had not at any time liquidated any assets from the FGF for the Government to use in the discharge of its expenses[lxvii] and had, up to that date, re-invested all income earned by the FGF.[lxviii]
190- وفيما يتعلق بخسائر حوافظ الاستثمار، تؤكد الكويت مجدداً أنه قبل غزو العراق للكويت واحتلاله لها، لم تُقْدم في أي وقت على تصفية أي أصول من " صندوق الأجيال القادمة " لكي تستعمـلها الحكومة في تغطية نفقاتها(67) وأنها، إلى غاية ذلك التاريخ، أعادت استثمار كل الدخل الذي اكتسبه " صندوق الأجيال القادمة " (68).

These profits (investment income) that KIA would have earned are due to Kuwait ... in order to restore Kuwait to the position in which it would have been but for the Iraqi aggression.” Kuwait asserts that the actual returns on the unliquidated portions of the FGF are the “most appropriate measure of rate of return to be used for valuing the Portfolio Loss”.
وهذه الأرباح (بفعل الاستثمار) التي كان بإمكان الهيئة الكويتية العامة للاستثمار أن تكسبها، مستحقة للكويت ... بغية استعادة الموقع الذي كان بالإمكان أن تكون عليه الكويت لو لم تتعرض للاعتداء العراقي " . وتؤكد الكويت أن العائدات الفعلية من الأجزاء غير المصفاة من صندوق الأجيال القادمة هي " أنسب مقياس لمعدل العائدات يمكن استخدامه لتقييم خسائر الحافظة " .
