46- ومع التسليم بأن الأسرة الحاضنة تمثل شكلاً مقبولاً وشائعاً من أشكال الرعاية البديلة في العديد من الدول الأطراف، فإن أسراً حاضنة كثيرة رغم ذلك تتردد في رعاية طفل معوق وذلك لأنه يمثل في أغلب الأحيان تحدياً لمواجهة الرعاية الإضافية التي قد يحتاج إليها والمستلزمات الخاصة في تنشئته البدنية والنفسية والعقلية.

46- ومع التسليم بأن الأسرة الحاضنة تمثل شكلاً مقبولاً وشائعاً من أشكال الرعاية البديلة في العديد من الدول الأطراف، فإن أسراً حاضنة كثيرة رغم ذلك تتردد في رعاية طفل معوق وذلك لأنه يمثل في أغلب الأحيان تحدياً لمواجهة الرعاية الإضافية التي قد يحتاج إليها والمستلزمات الخاصة في تنشئته البدنية والنفسية والعقلية.

95. Article 3 lays down the following conditions to be fulfilled by the foster family:
٥٩- والمادة ٣ التي تشير إلى أنه يجب أن تتوافر في اﻷسرة الكافلة ما يلي:

(e) Proper hygienic conditions must be assured in the residence of the foster family;
)ﻫ( أن تتوافر في المسكن الذي تقيم فيه اﻷسرة الكافلة الشروط الصحية اللازمة؛

According to the Code, fostership may be annulled and the foster child returned to the Department in the case of a violation by the foster family of the fostership conditions established by the Code.
ووفقاً لأحكام هذا القانون فإنه يتم إلغاء الحضانة وإعادة المحتضن إلى إدارة الحضانة العائلية في حالة خروج الأسرة عن شروط الرعاية المنصوص عليها في القانون.
