17. In relation to the topic " Expulsion of aliens " , the Commission considered the fifth report of the Special Rapporteur (A/CN.4/611 and Corr.1), dealing with questions relating to the protection of the human rights of persons who have been or are being expelled.
17- وبخصوص موضوع " طرد الأجانب " ، نظرت اللجنة في التقرير الخامس الذي أعده المقرر الخاص (A/CN.4/611 وCorr.1) والذي تناول مسائل تتعلق بحماية حقوق الإنسان للأشخاص الذين طُردوا أو يجري طردهم.

30. With respect to the draft articles on the expulsion of aliens, his delegation considered that the codification of the human rights of persons who had been or were being expelled was useful, provided that such codification was guided by the principle of comprehensive protection of the human rights of the person in question, and did not infringe on the sovereignty of States.
30 - وفيما يتعلق بمشاريع المواد المتعلقة بطرد الأجانب، قال إن وفده يعتبر أن تدوين حقوق الإنسان للأشخاص الذين تعرّضوا للطرد أو يكونون موضوعات للطرد أمر مفيد شريطة أن يسترشد هذا التدوين بمبدأ الحماية الشاملة لحقوق الإنسان للشخص المعني، وألاّ يتعدّى على سيادة الدول.

40. With regard to draft article 8 (General obligation to respect the human rights of persons who have been or are being expelled), her delegation firmly believed that the establishment of a hierarchy among such rights should be avoided and that it would be extremely difficult to set out an exhaustive list of rights to be protected in the context of expulsion.

25. Mr. Troncoso (Chile) said that, in principle, expulsion of aliens was governed by domestic law; clearly, however, some of the issues involved did not lie exclusively within domestic jurisdiction and might be governed by international law, notably the human rights of persons who had been or were being expelled.

Mr. Serpa Soares (Portugal) said, with regard to the topic of expulsion of aliens, that the provisions relating to the death penalty and torture or inhuman or degrading treatment in the revised and restructured draft articles on protection of the human rights of persons who had been or were being expelled (A/CN.4/617) required further consideration.

The Special Rapporteur then submitted to the Commission a document containing a set of draft articles on protection of the human rights of persons who have been or are being expelled, revised and restructured in the light of the plenary debate (A/CN.4/617).
