١٢ - ومن رأي اللجنة أن توقيع عقوبة اﻹعدام لدى اختتام دعوى قضائية لم تحترم أحكام العهد إنما تشكل، اذا لم يتح أي استئناف آخر للحكم الصادر، انتهاكا للمادة ٦ من العهد.

١٠-٦ لذلك ترى اللجنة أن إصدار حكم باﻹعدام في نهاية محاكمة لم تكن قائمة على احترام أحكام العهد يشكﱢل، في حالة تعذر تقديم استئناف آخر ضد هذا الحكم، انتهاكا للمادة ٦ من العهد.

In view of the above, it is also submitted that the imposition of a sentence of death upon the conclusion of a trial in which the provisions of the Covenant have been violated constitutes a violation of article 6, paragraph 2, of the Covenant.

Therefore, it is not only the execution of a juvenile offender which constitutes a violation of international law, but also the imposition of a sentence of death on a juvenile offender by itself.
