وأخيراً فقد جاء في الفقرة ٧٤ من التقرير اﻷولي أن اﻷشخاص دون سن الخامسة عشرة لا يعتبرون أهلاً للشهادة إلاّ في القضايا المنطوية على الاغتصاب واﻷفعال المنافية للحشمة، وهي ترى أن هذا الاستثناء ينبغي أن يمتد حتماً ليشمل كل القضايا التي تمس مصالح الطفل الفضلى.
