In July 2006, the Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism expressed concern at the legislation applicable to crimes of terrorism, in particular that resulting from the Jordanian Penal Code and the Draft Terror Prevention Law.

The provisions governing terrorism in the Jordanian Penal Code do not cover terrorist acts carried out using nuclear materials. Provision for these and for the penalties to be imposed in the event of their perpetration must therefore be made and explicitly so, leaving no room for interpretation.

12. The relevant provision in domestic law which criminalizes torture (art. 208 of the Jordanian Penal Code) stipulates:

The provisions relating to foreign criminal judgements are governed by articles 12 and 13 of the Jordanian Penal Code.

Moreover, in accordance with article 147 (2) of the Jordanian Penal Code (Act No. 16 of 1960) any bank transaction related to terrorist activities constitutes a terrorist act and the Prosecutor General, in coordination with the Central Bank and any relevant domestic or international party, is vested with broad powers to carry out the appropriate investigations. 1.12.

46. There have been no trials (as set out in paragraph 18 of the list of issues) for lack of evidence that any crime has been committed pursuant to article 208 of the Jordanian Penal Code.
46- لم تجر أية محاكمات على نحو ما هو وارد في الفقرة 18 من قائمة المسائل التي ستنظر فيها لجنة مناهضة التعذيب لدى مناقشة التقرير الوطني للأردن، وذلك لعدم ثبوت ارتكاب أية جريمة وفقاً للمادة 208 من قانون العقوبات الأردني.

The Jordanian courts are competent to deal with criminal acts carried out by any Jordanian, on the basis of the principle of personal jurisdiction laid down in article 10 of the Jordanian Penal Code, so long as such person has not been convicted outside Jordan for the same crime and the sentence has been served, lapsed because of the statute of limitations or been the subject of a pardon.
فإن المحاكم الأردنية تختص بالنظر في الأعمال الجرمية التي تنفذ من قِبل أي أردني سندا لقاعدة الاختصاص الشخصي المنصوص عليها في المادة (10) من قانون العقوبات الأردني ما لم يكن الشخص الأردني قد حوكم على ذات الجرم في الخارج ونفذ فيه هذا الحكم أو سقط عنه بالتقادم أو العفو.

Furthermore, the Government has amended the Jordanian Penal Code (Act No. 16 of 1960) by Act No. 54 of 2001, in accordance with resolution 1373 (2001), which was adopted following the events of 11 September 2001. That involved amending the provisions by which acts of terrorism are criminalized, including the financing of such acts and conspiracy to commit them, which are set forth in its articles 147 to 149.
وعليه، فقد تم تعديل قانون العقوبات الأردني رقم (16) لسنة 1960 بموجب القانون المعدل رقم (54) لسنة 2001 بشكل يتماشى مع القرار (والذي تم اعتماده بعد أحداث 11 أيلول/سبتمبر 2001) حيث جاء التعديل بأحكام وافية لتجريم الأعمال الإرهابية بما في ذلك تمويلها والمؤامرة على اقترافها في مواده (147-149).

Furthermore, article 308 of the Jordanian Penal Code lowers the sentence against the perpetrator if a " legal and correct marriage contract is forged " between him and the victim.
