Territorial organization: article 66 of the Judicial Code establishes that the territory of the Republic has four judicial districts.
التقسيم: تنص المدونة القضائية في المادة ٦٦ منها على أن يقسم إقليم الجمهورية إلى أربع مناطق قضائية.

First, it plays the role of investigating judge in the pre-trial phase, in accordance with article 2007 of the Judicial Code:
إذ أنه يؤدي، من ناحية، مهمة قاضي التحقيق في المرحلة التمهيدية حسبما تنص عليه المادة ٢٠٠٧ من المدونة القضائية:

The State party referred to articles 94, 95 and 97 the Constitution and article 11 of the Judicial Code.

Thus, paragraph 15 of article 98 of the Judicial Code provides as follows:

If the person reappears after the decision to declare absence has been handed down and become final, that decision may be rectified in accordance with article 101 of the Civil Code and articles 1383 to 1385 of the Judicial Code.
وإذا ظهر شخص بعد القرار النهائي للإعلان عن الاختفاء، يمكن تصحيح القرار وفقاً للمادة 101 من القانون المدني والمواد من 1383 إلى 1385 من المدونة القضائية.

101. Article 188 of the Judicial Code states that in criminal matters the Office of the Public Prosecutor investigates offences committed within the territory of the Republic, receives reports, conducts all examination proceedings and refers cases to the courts.
101- ويحدد قانون القضاء في مادته 188 بأنه في مجال الزجر، تقوم النيابة العامة بالتحري عن الجرائم المرتكبة في أراضي الجمهورية، وتتلقى البلاغات، وتقوم بجميع أعمال التحقيق، وترفع الدعوى أمام القضاء.

Article 1995 of the Judicial Code states:
وفيما يلي نص المادة 1995 من القانون القضائي:

Article 2. A fifth paragraph shall be added to article 127 of the Judicial Code, as follows:
المادة 2 - يُضاف البند 5 إلى المادة 127 من القانون القضائي كالتالي:

The Ministry will send the requests received to the Chamber IV (Sala de Negocios Generales) of the Supreme Court of Justice in accordance with article 101, section 3 of the Judicial Code.
تبعث الوزارة الطلبات التي تلقتها إلى الدائرة الرابعة للشؤون العامة التابعة لمحكمة العدل العليا عملا بالفقرة الفرعية 3 من المادة 101 من القانون القضائي.

The Committee also notes the author's contention that the remedy provided under article L 7811 of the Judicial Code is restrictive and ineffective.
كما أحاطت اللجنة علماً بحجج صاحب البلاغ الذي يصف وسيلة الانتصاف المنصوص عليها في المادة L 781-1 من قانون النظام القضائي بأنها تقييدية وغير فعالة.

In the Committee's view, the author has failed to substantiate sufficiently his arguments in rebuttal of the State party's claim that article L 7811 of the Judicial Code provided an effective remedy.
وترى اللجنة أن صاحب البلاغ لم يدعم بصورة كافية حجته المعارضة لشرح الدولة الطرف الذي يشير إلى أن المادة L 781-1 من قانون النظام القضائي تنص على وسيلة انتصاف فعالة.

They assert that article L 7811 of the Judicial Code in fact establishes a highly restrictive, unworkable form of State responsibility.
