However, this does not signify that an accused who does not understand the language used in court has the right to be furnished with translations of all relevant documents in a criminal investigation, provided that the relevant documents are made available to his counsel.

80. A suspect, an accused and a defendant shall be provided free of charge with the services of an interpreter if they do not understand the language used in court or do not speak that language.

In the same resolution, the Council encouraged States to ensure that defendants who did not sufficiently understand the language used in court were fully informed, by way of interpretation or translation, of all the charges against them and the content of the relevant evidence deliberated in court.

101. The Committee notes with concern that the obligation established in article 14, paragraph 3 (f), of the Covenant to provide an interpreter for everyone charged with a criminal offence if he cannot understand or speak the language used in court is not reflected in the criminal legislation of all the cantons.
١٠١ - وتلاحظ اللجنة بقلق أن جميع التشريعات الجنائية للكانتونات لا تعكس الالتزام المنصوص عليه في الفقرة ٣ )و( من المادة ٤١ من العهد وهو الالتزام الذي يقضي بتوفير ترجمان ﻷي شخص يتهم بجريمة جزائية إذا كان لا يفهم أو لا يتكلم اللغة المستخدمة في المحكمة.

For this reason international instruments establish the right to have the free assistance of an interpreter if the accused cannot understand the language used in court. This has to do with the principles of fairness and equality of arms in criminal proceedings.
لذا، تنص الصكوك الدولية على حق المتَّهم في الاستعانة بمترجم مجاناً إذا كان لا يجيد تكلم اللغة المستخدمة في المحكمة أو فهمها()، إذ تضع هذه الصعوبات مبدأي الإنصاف وتكافؤ وسائل الدفاع على المِحك().

16. The Committee notes with concern that the obligation established in article 14, paragraph 3 (f), of the Covenant to provide an interpreter for everyone charged with a criminal offence if he cannot understand or speak the language used in court, is not reflected in the criminal legislation of all the cantons.
٦١- وتلاحظ اللجنة بقلق أن جميع التشريعات الجنائية للكانتونات لا تعكس الالتزام المنصوص عليه في الفقرة ٣)و( من المادة ٤١ من العهد وهو الالتزام الذي يقضي بتوفير ترجمان ﻷي شخص يتهم بجريمة جزائية إذا كان لا يفهم أو لا يتكلم اللغة المستخدمة في المحكمة.

For example, article 14, paragraph 3 (f), of the Covenant recognized the right of everyone charged with a criminal offence to have the free assistance of an interpreter if he could not understand or speak the language used in court, yet paragraph 261 of the initial report (CCPR/C/81/Add.8) stated that the cantonal code of Zug was the only one that did not make provision for the presence of an interpreter.
وتنص الفقرة ٣ )و( من المادة ٤١ من العهد، مثلاً، على حق كل متهم بارتكاب جريمة جنائية في الحصول مجاناً على مترجم إذا كان لا يفهم أو لا يتكلم اللغة المستخدمة في المحكمة بينما تفيد الفقرة ١٦٢ من التقرير اﻷولي (CCPR/C/81/Add.8) أن قانون كانتون زوغ فقط هو الذي لا ينص على وجود مترجم.

Defendants are to receive adequate assistance of counsel above and beyond that afforded in non-capital cases and those who do not sufficiently understand the language used in court are to be fully informed, by way of interpretation or translation, of all the charges against them and the content of the relevant evidence deliberated in court.

and recalls that the right to fair trial does not entail that an accused who does not understand the language used in court, has the right to be furnished with translations of all relevant documents in a criminal investigation, provided that the relevant documents are made available to his counsel.
وتشير اللجنة إلى قرارها السابق)٢(، وتذكّر بأن الحق في محاكمة عادلة لا يستتبع أن يكون للمتهم الذي لا يفهم اللغة المستخدمة في المحكمة الحق في الحصول على ترجمة لكل المستندات المتصلة بالتحقيق في الجريمة، بشرط أن يتاح لمحاميه ما يتصل بالموضوع من مستندات.

It refers to its general comment No. 32, where it stated that the right to have the free assistance of an interpreter if the accused cannot understand or speak the language used in court as provided for by article 14, paragraph 3 (f) enshrines another aspect of the principles of fairness and equality of arms in criminal proceedings.
وهي تشير إلى تعليقها العام رقم 32، حيث بيّنت أن الحق في الحصول مجاناً على مساعدة مترجم شفوي إذا لم يكن المتهم قادراً على فهم أو تكلم اللغة المستخدمة في المحكمة كما تنص عليه الفقرة 3(و) من المادة 14 يكرس جانباً آخر من مبدأ العدالة وتساوي الإمكانيات في الإجراءات الجنائية().

The Committee considers that not providing the author with an interpreter when he could not understand and speak the language used in court, constitutes a violation of article 14, paragraph 1, read in conjunction with article 14, paragraph 3 (f), of the Covenant.
وترى اللجنة أن عدم تخصيص مترجم شفوي لصاحب البلاغ، علماً بأنه لا يفهم اللغة المستخدمة في المحكمة ولا يتحدثها، يشكل انتهاكاً لأحكام الفقرة 1 من المادة 14 مقروءة بالاقتران مع الفقرة 3(و) من المادة 14 من العهد.

8.5 The Committee observes that the free assistance of an interpreter in cases where the parties concerned, such as the accused or the witnesses, cannot understand or speak the language used in court, is a fundamental fair trial guarantee enshrined in human rights treaties and further developed in the jurisprudence of treaty bodies.
8-5 وتلاحظ اللجنة أن توفير المساعدة المجانية من مترجم شفوي في القضايا التي لا يكون بوسع أطرافها، من قبيل المتهمين أو الشهود، فهم اللغة المستعملة في المحكمة أو التكلم بها، هو ضمانة أساسية من ضمانات المحاكمة العادلة المكرسة في معاهدات حقوق الإنسان()، والتي تطورت بقدر أكبر في الاجتهادات القضائية لهيئات المعاهدات().
