55. Mr. Khani Jooyabad (Islamic Republic of Iran) noted that the delegation of Canada had made a similar proposal at the last session of the Working Group.

The debate in the course of the last session of the Working Group has in fact proved that significant differences remain on such substantive matters as the size and composition of the Security Council, especially an increase in the permanent membership, and the power of veto.

13. A long debate took place during the last session of the Working Group of the Commission set up to consider the draft declaration. Representatives of indigenous groups argued in favour of a full-fledged right to self-determination, though that did not necessarily mean that the right would be used to secede from the States of which they now formed a part.
13- وقد دار نقاش طويل خلال الدورة الأخيرة للفريق العامل التابع للجنة والذي أُنشئ للنظر في مشروع الإعلان(2).إذ دعا ممثلو مجموعات الشعوب الأصلية إلى إقرار الحق الكامل في تقرير المصير، وإن كان ذلك لا يعني بالضرورة أن يستخدم هذا الحق للانفصال عن الدولة التي يشكلون حالياً جزءاً منها.

I made this suggestion in my analytical paper (E/CN.4/2006/WG.23/2, paras. 54 and 55) and several delegates expressed support for such provision at the last session of the Working Group.z In article 13, I have aimed to reflect this proposal, drawing inspiration and wording from article 22 of the Covenant and article 45, paragraph 3 of the Convention on the Rights of the Child.

She noted a number of activities undertaken by OHCHR since the last session of the Working Group, in particular the workshop on indigenous peoples, private sector natural resource, energy and mining companies and human rights held in December 2001 and the workshop on multiculturalism in Africa held in Botswana.

(3) In article 29, the new paragraph 2 introduces a useful new provision, the first sentence of which might be completed by the words " (...) impartiality and independence from the parties, their legal advisers and the arbitral tribunal " , as a delegation proposed during the last session of the Working Group.

Against the alternative solution referred to in the report on the last session of the Working Group (see A/CN.9/486, para 105 in fine), which would consist in allowing the draft UNIDROIT Convention and the various draft and preliminary draft Protocols thereto to supersede the draft Convention, a number of disadvantages are to be noted.

Mr. Smedinghoff (United States of America) said that his delegation had been comfortable with the text of draft paragraph 3 (b) at the last session of the Working Group but had since been convinced by consultations with other parties in the United States and by the comments submitted by Canada and Singapore that the draft paragraph should be deleted.
