يجوز حجز السفينة بغرض الحصول على ضمانة، حتى ولو كانت المطالبة البحرية التي يوقع الحجز بشأنها، سيُفصل فيها، بمقتضى بند اختصاصي أو بند تحكيمي وارد في أي عقد ذي صلة أو بمقتضى أمر آخر، في دولة غير الدولة التي يوقَع فيها الحجز، أو ستعرض للتحكيم، أو سيُفصل فيها وفقاً لقانون دولة أخرى.

“(2) With regard to matters settled in this chapter, the forum may decide to apply the mandatory rules of the law of another State with which the contract of assignment has a close connection, if and in so far as, under the law of that other State, those rules must be applied whatever the law applicable.”

If the contract of assignment is connected with one State only, the fact that the assignor and the assignee have chosen the law of another State does not prejudice the application of the law of the State with which the assignment is connected to the extent that law cannot be derogated from by contract. (2) As an exception to recommendation (1), the insolvency law may provide that the law of another State applies to the avoidability of a transaction or set-off that occurred or an obligation that was incurred before the commencement of insolvency proceedings.

The conflict-of-laws rules of many States now provide that reference to the law of another State as the law governing an issue refers to the law applicable in that State other than its conflict rules.
13- وتنص قواعد تنازع القوانين في العديد من الدول اليوم على أن الإشارة إلى قانون دولة أخرى باعتباره القانون الذي يحكم مسألة ما إنما تعني القانون المنطبق في تلك الدولة بخلاف قواعدها المتعلقة بتنازع القوانين.

Nothing in articles 27 to 29 restricts the application of the mandatory rules of the law of another State with which the matters settled in those articles have a close connection if and insofar as, under the law of that other State, those rules must be applied irrespective of the law otherwise applicable.
