If the applicable law is the law of the forum State or of another Contracting State that has not made this declaration, the Convention applies even if the parties do not have their places of business in different Contracting States.
وإذا كان القانون الواجب التطبيق هو قانون دولة المحكمة أو قانون دولة أخرى متعاقدة لم تصدر هذا الإعلان، كانت الاتفاقية سارية حتى لو لم يكن مقرا عمل الطرفين واقعين في دولتين متعاقدتين مختلفتين.

" 2- في اجراءات الاعسار التي تستهل في دولة غير الدولة التي يقع فيها مقر المحيل، اذا نشأ أي حق تفضيلي بمقتضى قانون دولة المحكمة وأعطي الأولوية على حقوق محال اليه في اجراءات اعسار تنظم في اطار قانون تلك الدولة، تكون لذلك الحق تلك الأولوية بصرف النظر عما تنص عليه المادة 24.

We are of the view that it would be better for the draft articles to contain a special provision to this effect in order to avoid any confusion. The draft provides only for objection to the default judgement and does not stipulate other possible methods of appealing against a judgement in accordance with the law of the forum State.
وإننا نرى من اﻷفضل أن يرد في الاتفاقية نص خاص بهذا الشأن منعا لكل التباس فالاتفاقية نصت على الاعتراض فقط على الحكم الغيابي ولم تنص على طرق الطعن اﻷخرى الممكنة على الحكم وفقا لقانون دولة المحكمة.

2- في اجراءات الاعسار التي تُستهل في دولة غير الدولة التي يقع فيها مقر المحيل، يجوز، بصرف النظر عما تنص عليه المادة 24، اعطاء الأولوية لأي حق تفضيلي ينشأ، بإعمال القانون، بمقتضى قانون دولة المحكمة وتُعطى له صفة الأولوية على حقوق محال اليه في اجراءات الاعسار التي تُنظم بمقتضى قانون تلك الدولة.

One approach would be to refer enforcement remedies to the law of the place of enforcement, i.e. the law of the forum State (lex fori).
62- ويتمثل أحد النهوج في الرجوع في سبل الانتصاف الإنفاذية إلى قانون مكان الإنفاذ، أي قانون دولة المحكمة (قانون البلد الذي تُقام فيه الدعوى).

The Commission should clarify whether draft article 1 required an initial determination that the law of the forum State applied, in which case draft article 18 would have to be revised, or whether draft article 1 provided for autonomous scope of application, in which case draft article 18 could remain unchanged.
وينبغي للجنة توضيح ما إذا كان مشروع المادة 1 يشترط أن يتم أولا تحديد أن قانون دولة المحكمة ينطبق - وفي هذه الحالة سيكون لا بد من تنقيح مشروع المادة 18 - أو ما إذا كان مشروع المادة 1 ينص على نطاق انطباق مستقل، وبالتالي يمكن أن يظل مشروع المادة 18 بدون تغيير.

That understanding appeared to be confirmed by the way in which exclusions were currently set out in draft article 18, since the possibility of lodging an exclusion under paragraph 1 (b) of draft article 18 would make no sense if draft article 1 itself required that the law of the forum State be the applicable law.

According to the conflict-of-laws rules of many States, the forum State may refuse the application of the law determined under its conflict-of-laws rules only if the effect of its application would be manifestly contrary to the public policy of the forum State or to provisions of the law of the forum State that are mandatory even in international situations.
75- وفقا لقواعد تنازع القوانين في العديد من الدول، لا يجوز لدولة المحكمة أن ترفض تطبيق القانون المحدد بمقتضى قواعد تنازع القوانين التي تعمل بها إلا إذا كان أثر هذا التطبيق مخالفا بوضوح للسياسة العامة لدولة المحكمة أو للأحكام الإلزامية لقانون دولة المحكمة حتى في الحالات الدولية.
