The contract shows that the Leasing Contract was signed, on behalf of West Africa Air Services, by Mr. LeRoy Urey.
ويتبين من العقد أن عقد الاستئجار وقع باسم شركة الخدمات الجوية لغرب أفريقيا، من طرف السيد لوروي أوري.

Further, Shafco alleges that as a result of such losses it was not awarded a new contract for the provision of services similar to those covered under the Leasing Contract to the Joint Operations after the liberation of Kuwait.

232- ويرى الفريق أنه نتيجة لقيام العراق بغزو واحتلال الكويت بصورة غير مشروعة، لم تتمكن شافكو من مواصلة أداء أعمالها بموجب عقد التأجير بعد 2 آب/أغسطس 1990.

Accordingly, title to the Buildings passed to the Joint Operations when the Leasing Contract was terminated as a result of Iraq’s unlawful invasion and occupation of Kuwait.
وتبعاً لذلك، فقد انتقلت ملكية المباني إلى العمليات المشتركة عند انهاء عقد التأجير نتيجة لقيام العراق بغزو واحتلال الكويت بصورة غير مشروعة.

This element of Shafco’s claim has two components: First, Shafco alleges that Iraq’s unlawful invasion and occupation of Kuwait caused it to fail to earn income under the Leasing Contract for the remainder of its term, a period of 15.5 months plus a six-month extension period.

230- ومن أجل حساب خسارة أرباحها، قامت شافكو بطرح بعض النفقات غير المتكبدة بعد 2 آب/أغسطس 1990 من الايرادات المتوقعة خلال فترة سريان عقد التأجير وبعد انتهائه.

Specifically, it has subtracted costs with respect to Shafco’s performance under the Leasing Contract from revenues expected by Shafco under such contract between 2 August 1990 and the end of its term.
وقام الفريق، تحديداً، بطرح التكاليف المتصلة بأداء شافكو لمهامها بموجب عقد التأجير من الإيرادات المتوقعة لشافكو بموجب هذا العقد في الفترة بين 2 آب/أغسطس 1990 وتاريخ انتهاء العقد.

Such revenues were calculated by multiplying the “total monthly price” as stated in the Leasing Contract by 15.5 months, the remainder of the term of such contract.

Shafco claims that on 3 August 1990 Iraqi troops compelled it to end its operations at Wafra; as a result, the Joint Operations invoked the “force majeure” clause of the Leasing Contract on 21 August 1990, depriving Shafco of further revenues from the Leasing Contract.
227- وتزعم شافكو أن الجنود العراقيين قد أجبروها في 3 آب/أغسطس 1990 على إنهاء عملياتها في الوفرة؛ ونتيجة لذلك، فقد احتجت العمليات المشتركة في 21 آب/أغسطس 1990 بشرط " القوة القاهرة " المنصوص عليه في عقد التأجير، مما حرم شافكو من إيرادات إضافية كانت ستجنيها من عقد التأجير.

It therefore turns its attention to the valuation of the resulting loss; in performing such valuation, the Panel has referred to decision 9, which sets forth certain methods for the valuation of losses relating to income-producing property.The Panel is not persuaded by Shafco’s claim that the term of the Leasing Contract would have been extended by six months pursuant to its extension clause.

Shafco has not provided evidence of such an invocation; nor has it shown that, if Iraq had not invaded Kuwait, it would have been likely to occur.The Panel also rejects Shafco’s assumption that, if Iraq’s unlawful invasion and occupation of Kuwait had not occurred, it would have entered into a new contract to lease the Machinery to the Joint Operations at the end of the term of the Leasing Contract.
ولم تقدم شافكو أدلة على ذلك كما أنها لم تثبت أن حدوث ذلك كان أمراً محتملاً لو لم يقم العراق بغزو الكويت. 234- كما يرفض الفريق ما زعمته شافكو من أنه لولا قيام العراق بغزو واحتلال الكويت بصورة غير مشروعة لكانت قد دخلت في عقد جديد لتأجير آلياتها للعمليات المشتركة عند انتهاء مدة عقد التأجير.
