A. Background on provisions of the Liability and Registration Conventions 4. Article I of the Liability Convention and the Registration Convention each contains the following, identical definition of the launching State:

125- وأعرب عن رأي مفاده أن القانون العام للمسؤولية سينطبق على الأنشطة الفضائية التي تضطلع بها الدول غير الأطراف في اتفاقية المسؤولية واتفاقية التسجيل.

41. The view was expressed that space-related intergovernmental organizations and their member States should consider the possible steps that might be taken to bring the activities of those intergovernmental organizations into the framework of the Rescue Agreement, the Liability Convention and the Registration Convention.
41- وأعرب عن رأي مفاده أن المنظمات الحكومية الدولية ذات الصلة بالفضاء والدول الأعضاء فيها ينبغي أن تنظر في الخطوات الممكنة التي قد تتخذ لجعل أنشطة تلك المنظمات الحكومية الدولية منـزوية ضمن اطار اتفاق الإنقاذ واتفاقية المسؤولية واتفاقية التسجيل.

6. The Working Group considered, following technical presentations at the thirtyseventh session of the Scientific and Technical Subcommittee, in 2000, new launch systems and ventures and other aspects of space activity that might raise questions of interpretation under the Liability Convention and the Registration Convention.
6- وفي أعقاب عروض تقنية قدمت في الدورة السابعة والثلاثين للجنة الفرعية العلمية والتقنية في عام 2000، نظر الفريق العامل في نظم ومشاريع الاطلاق الجديدة وغيرها من جوانب النشاط الفضائي التي قد تطرح مسائل تتعلق بالتفسير بمقتضى اتفاقية المسؤولية واتفاقية التسجيل.

16. The Working Group noted that national space laws had elements in common and that, in some cases, governments and non-governmental entities were adopting similar practices under the Liability Convention and the Registration Convention.
16- ولاحظ الفريق العامل أن في قوانين الفضاء الوطنية عناصر مشتركة وأن الحكومات والهيئات غير الحكومية تقوم، في بعض الحالات، باعتماد ممارسات متشابهة بمقتضى اتفاقية المسؤولية واتفاقية التسجيل.

9. The Working Group noted that some questions of interpretation under the Liability Convention and the Registration Convention were being addressed on a regular basis by national space regulatory bodies and intergovernmental organizations that had declared their acceptance of the rights and obligations provided for in the Liability Convention and the Registration Convention.
9- ولاحظ الفريق العامل أن بعض المسائل المتعلقة بالتفسير في إطار اتفاقية المسؤولية واتفاقية التسجيل تعالج بانتظام من جانب الهيئات الرقابية الفضائية الوطنية والمنظمات الحكومية الدولية التي كانت قد أعلنت عن قبولها للحقوق والالتزامات المنصوص عليها في اتفاقية المسؤولية واتفاقية التسجيل.

In September, Nigeria had launched its first space satellite -- the Sat-I -- a low-Earth-orbit microsatellite for disaster monitoring, which was part of a constellation of four other microsatellites owned by the United Kingdom, Algeria, Thailand and Viet Nam. Nigeria had also recently signed the Liability Convention and the Registration Convention.
وفي أيلول/سبتمبر، أطلقت نيجيريا أول سواتلها الفضائية Sat-I وهو عبارة عن ساتل متناه في الصغر يدور حول المدار المنخفض للأرض من أجل رصد الكوارث وهو أيضاً عبارة عن جزء من تجمع لأربعة سواتل متناهية الصغر تمتلكها المملكة المتحدة والجزائر وتايلند وفيتنام إضافة إلى أن نيجيريا وقَّعت مؤخراً اتفاقية المسؤولية واتفاقية التسجيل.

Mr. Abiodun (Nigeria) speaking as Chairman of the working group of the whole on agenda item 74 and introducing the draft resolutions under that item, said that the draft resolution entitled " Application of the concept of the `launching State'" was aimed at facilitating adherence to and the application of United Nations treaties on outer space, in particular the Liability Convention and the Registration Convention.

The view was expressed that intergovernmental organizations conducting space activities and their member States should consider possible steps they could take to declare acceptance of the rights and obligations under the Rescue Agreement, the Liability Convention and the Registration Convention.
47- ورئي أنه ينبغي للمنظمات الحكومية الدولية التي تضطلع بأنشطة فضائية وللدول الأعضاء فيها أن تنظر فيما يمكن أن تتخذه من خطوات لإعلان قبولها بالحقوق والالتزامات المنصوص عليها في اتفاق الإنقاذ واتفاقية المسؤولية واتفاقية التسجيل.

The view was expressed that, in the event that the General Assembly took action on the proposed resolution, that delegation would declare that the spirit and the letter of the Outer Space Treaty, the Liability Convention and the Registration Convention would guide its activities in outer space.
43- وأعرب عن رأي مفاده أنه، في حال اتخذت الجمعية العامة إجراء بشأن القرار المقترح، فان الوفد الذي أبدى ذلك الرأي سيعلن أنه سيسترشد في أنشطته في الفضاء الخارجي بروح ونص معاهدة الفضاء الخارجي واتفاقية المسؤولية واتفاقية التسجيل.

59- وأُعرب عن رأي مفاده أن المنظمات الحكومية الدولية التي تقوم بأنشطة فضائية، وكذلك الدول الأعضاء فيها، ينبغي أن تنظر في القيام بالخطوات الممكنة لجعل أنشطة تلك المنظمات الحكومية الدولية تندرج في إطار اتفاق الإنقاذ واتفاقية المسؤولية واتفاقية التسجيل.
