The Convention provides, in its part VII, for a set of rules to regulate the management and the conservation of the living resources of the high seas.

The high seas fishing States, together with coastal States concerned, have the duty to conserve and manage the living resources of the high seas.

On the other hand, States have a responsibility to use a method of fishing which is consistent with the duty imposed on all States with respect to the conservation and management of the living resources of the high seas.

It should be noted that General Assembly resolution 44/225 of 22 December 1989, entitled " Large-scale pelagic drift-net fishing and its impact on the living marine resources of the world's oceans and seas " , has provided a special role for regional organizations in the conservation and management of the living resources of the high seas. 25/
وجدير بالملاحظة أن قرار الجمعية العامة ٤٤/٢٢٥ المؤرخ ٢٢ كانون اﻷول/ديسمبر ١٩٨٩، والمعنون " صيد السمك بالشباك البحرية العائمة الكبيرة وأثره على الموارد البحرية الحية في محيطات العالم وبحاره " ، أنشأ دورا خاصا للمنظمات الاقليمية بالنسبة لحفظ الموارد البحرية في أعالي البحار وادارتها)٢٥(.

6. The Convention establishes a general obligation on all States to cooperate in the conservation and management of the living resources of the high seas.
٦ - تفرض الاتفاقية واجبا عاما على كافة الدول هو أن تتعاون في حفظ الموارد الحية في أعالي البحار وادارتها.

This obligation of cooperation is also inherent in the obligations under article 119 of determining the allowable catch and taking other measures for the conservation and management of the living resources of the high seas.
هذا الالتزام بالتعاون كامن أيضا في الالتزامات المترتبة بموجب المادة ١١٩ بتحديد كمية الصيد المسموح بها واتخاذ تدابير أخرى لحفظ وإدارة الموارد الحية في أعالي البحار.

In this regard, particular attention should be directed to the responsibility of States under article 117 of the Convention for taking measures with respect to their nationals concerning the conservation of the living resources of the high seas.
وفي هذا الصدد، ينبغي توجيه اهتمام خاص نحو مسؤولية الدول بموجب المادة ١١٧ من الاتفاقية فيما يتعلق باتخاذ تدابير إزاء مواطنيها بشأن حفظ الموارد الحية في أعالي البحار.

That Conference succeeded in adopting four Conventions: the Convention on the Territorial Sea and Contiguous Zone, the Convention on the High Seas, the Convention on the Continental Shelf, and the Convention on Fishing and Conservation of the living resources of the high seas.

In waters beyond 200 miles, the Convention sets forth basic principles for cooperation among States in the conservation and management of the living resources of the high seas, including straddling stocks and highly migratory species.
وفي المياه خارج منطقة اﻟ ٢٠٠ ميل، تضع الاتفاقية مبادئ أساسية للتعاون فيما بين الدول في الحفاظ على الموارد الحية في أعالي البحار وفي إدارتها، بما في ذلك اﻷرصدة السمكية المتداخلة والكثيرة الارتحال.

Article 117 also requires States to cooperate with other States in taking such measures as may be necessary for the conservation of the living resources of the high seas.

14. Neither the term " discrete high seas fish stocks " nor the concept behind it are used in part VII of the Convention, which addresses the living resources of the high seas in general.
14 - ولم يستخدم مصطلح " الأرصدة السمكية المنفصلة الموجودة في أعالي البحار " أو المفهوم الكامن وراءه في الجزء السابع من الاتفاقية الذي يتناول الموارد الحية في أعالي البحار عموما.

3. Article 119 of the Convention sets out the factors to be considered in determining the allowable catch and establishing other conservation measures for the living resources of the high seas.
٣ - وتنص المادة ١١٩ من الاتفاقية على العوامل التي يتعين مراعاتها في تحديد كمية الصيد المسموح بها وتقرير التدابير اﻷخرى لحفظ الموارد الحية ﻷعالي البحار.

6. The basic framework set out in the informal single negotiating text was derived from the 1958 Geneva Conventions on the High Seas and on Fishing and Conservation of the living resources of the high seas.
٦ - وكان اﻹطار اﻷساسي المنصوص عليه في النص التفاوضي الوحيد غير الرسمي مستمدا من اتفاقيات جنيف المتعلقة بأعالي البحار وبصيد اﻷسماك وحفظ الموارد الحية ﻷعالي البحار لعام ١٩٥٨.

It is an obligation imposed on all States to take such measures in respect of their own nationals " as may be necessary for the conservation of the living resources of the high seas " or to cooperate with other States in taking such measures.
وهو التزام يفرض على جميع الدول اتخاذ هذه التدابير بالنسبة الى رعاياها " من أجل حفظ الموارد الحية ﻷعالي البحار " أو التعاون مع دول أخرى لاتخاذ تلك التدابير.

13. The Conference, therefore, has to consider the practical means necessary to give effect to the provisions of the Convention relevant to straddling fish stocks and highly migratory fish stocks, taking into account the general obligation of States concerning the conservation and management of the living resources of the high seas.
١٣ - لذا يتعين على المؤتمر النظر في الوسائل العملية اللازمة ﻹعمال أحكام الاتفاقية المتصلة باﻷرصدة السمكية المتداخلة المناطق واﻷرصدة السمكية الكثيرة الارتحال، على أن يوضع في الاعتبار واجب الدول العام ازاء حفظ الموارد الحية ﻷعالي البحار وادارتها.

The provisions of article 63 (2) and 64 to 67, though found in the section of the Convention on the exclusive economic zone, have important consequences for the conservation and management of the living resources of the high seas.
ويترتب على أحكام الفقرة )٢( من المادة ٦٣ والمواد من ٦٤ إلى ٦٧، بالرغم من أنها توجد في الفرع الخاص بالمنطقة الاقتصادية الخالصة من الاتفاقية، نتائج هامة بحفظ وإدارة الموارد الحية ﻷعالي البحار.
