(ه) لا يعتبر انعدام إمكانية استخدام الأموال المودعة في المصارف العراقية خسارة مباشرة ما لم يستطع صاحب المطالبة إثبات أن العراق كان مطالبا تعاقديا أو بموجب التزام آخر محدد بصرف تلك الأموال بعملات قابلة للتحويل وبالسماح بنقل الأموال المحوَّلة إلى خارج العراق وأن عملية الصرف والتحويل هذه قد حال دونها قيام العراق بغزو واحتلال الكويت.

For the same reasons that the Panel found that the economic value of the loss of use of the Embassy premises was not quantifiable, because of the nature of the activities carried out by diplomatic missions, the loss in the present Claims is not amenable to monetary evaluation.
ولﻷسباب ذاتها انتهى الفريق إلى أن القيمة الاقتصادية التي يمثلها عدم استخدام مبنى السفارة لا يمكن تحديدها بسبب طبيعة اﻷنشطة التي تقوم بها البعثات الدبلوماسية، فليس من السهل إجراء تقييم نقدي للخسارة في هذه المطالب.

That decision provides that interest will be awarded from the date the loss occurred until the date of payment, at a rate sufficient to compensate successful claimants for the loss of use of the principal amount of the award; that the methods of calculation and of payment of interest will be considered by the Governing Council at the appropriate time; and that interest will be paid after the principal amount of awards.

وينص المقرر 16 في جزء منه على أن " تستحق الفوائد من تاريخ الخسارة التي حدثت وحتى تاريخ الدفع، وذلك بمعدل يكفي لتعويض أصحاب المطالبات المقبولة عما فاتهم من كسب في الانتفاع بأصل مبلغ التعويض " .

The idea behind the allowance of such interest is not to provide a gain or profit, but to compensate the claimant for the loss of use of money over time caused by the delay in payment of the principal amount of the claim.
والفكرة وراء تخصيص هذه الفائدة ليست هي توفير مكسب أو ربح، وإنما تعويض المطالب على خسارة الانتفاع بالمال عبر الزمن الناتجة عن التأخر في دفع المبلغ الرئيسي للمطالبة.

The Panel considers that any claim that arises because of the delay in payment of compensation is a claim that arises in fact because of the loss of use of the principal amount of the award, and Governing Council decision 16 addresses all these claims.
ويرى الفريق أن أي مطالبة تنجم بسبب التأخر في دفع التعويض هي مطالبة تنجم في الواقع بسبب خسارة الانتفاع بالمبلغ الرئيسي للتعويض، وأن مقرر مجلس الإدارة 16 يتناول جميع هذه المطالبات.

For the same reasons that the Panel found that the economic value of the loss of use of the Embassy premises was not quantifiable, because of the nature of the activities carried out by diplomatic missions, this type of loss was also not amenable to monetary evaluation.Ibid.
وللأسباب ذاتها انتهى الفريق إلى أن القيمة الاقتصادية التي يمثلها عدم استخدام مبنى السفارة لا يمكن تحديدها بسبب طبيعة الأنشطة التي تقوم بها البعثات الدبلوماسية؛ ولذلك فليس من السهل إجراء تقييم نقدي للخسارة في هذه المطالب(8).

iii) Thirdly, by the award of interest to the funding entity under decision 16 on the compensation awarded to it for the loss of use of the sum of 267 (from the relevant dates of loss as set out in paragraph 438 below until the date of payment of compensation).
`3` ثالثاً، بمنح فائدة للهيئة الممولة بموجب المقرر 16 عن التعويض الممنوح لها لخسارة الانتفاع بمبلغ 267 (من تواريخ الخسارة ذات الصلة كما حددت في الفقرة 438 أدناه حتى تاريخ دفع التعويض).

The Panel also finds that the loss of use of lost, damaged or destroyed assets that are the subject of the underlying claims will be compensated by award of interest under Governing Council decision 16 for the period from the date of loss for those underlying claims.
308- ويرى الفريق أيضاً أن الخسارة الناجمة عن عدم الانتفاع بالأصول التي فُقدت أو أُصيبت بضرر أو دُمرت والتي تشكل موضوع المطالبات الأصلية سوف يعوض عنها بدفع فائدة بموجب المقرر 16 لمجلس الإدارة عن الفترة التي تبدأ من تاريخ الخسارة المتعلقة بالمطالبات الأصلية.

In respect of the claims for losses resulting from a delay in receiving payment for the goods, the Panel determines that such claims are for the loss of use of funds.
88- وفيما يتعلق بالمطالبات بالتعويض عن الخسائر التي نجمت عن تأخير في الحصول على ثمن السلع، يقرر الفريق أن هذه المطالبات هي بسبب عدم إمكانية استخدام الأموال.
