٢٤ - لا يجوز بأي حال من اﻷحوال أن تشمل أحكام قانون المصالحة الوطنية - التي تقرر سقوط المسؤولية الجنائية - الجرائم التي لا تسقط بالتقادم أو التي لا مجال فيها لسقوط المسؤولية الجنائية، وذلك وفقا للقانون الداخلي أو المعاهدات الدولية التي تكون غواتيمالا قد صدقت أو وقﱠعت عليها.

22. Also in relation to the clause mentioned in paragraph 20, the National Reconciliation Act shall extinguish criminal liability for related common crimes committed in the armed conflict, such crimes being defined as those which are directly, objectively, intentionally and causally related to the commission of the political crimes referred to in the preceding paragraph and which cannot be shown to be motivated by personal goals.
٢٢ - فيما يتعلق بذات المفهوم القانوني المشار إليه في الفقرة ٢٠ أعلاه، يقرر قانون المصالحة الوطنية كذلك سقوط المسؤولية الجنائية عن الجرائم العادية المرتبطة بجرائم أخرى، التي ارتكبت إبان النزاع المسلح والتي يقصد بها الجرائم المباشرة الفعلية العمد التي لها علاقة سببية بارتكاب الجرائم السياسية المشار إليها في الفقرة السابقة، والتي لم يثبت توافر أسباب شخصية كدافع وراء ارتكابها.

The State party should strictly apply the National Reconciliation Act, which explicitly excludes any amnesty for the perpetrators of acts of torture and other grave human rights violations, ensures the initiation of prompt, effective, independent and thorough investigations of all acts of torture and other grave human right violations committed during the internal armed conflict, and grants adequate compensation to the victims.

The International Commission of Jurists noted that the National Reconciliation Act has not been enforced adequately by the State and that the remedy of amparo is being used unlawfully or abusively to obstruct the trials of persons accused of committing serious human rights violations.

وفي ٢٥ أيلول/سبتمبر ١٩٩٢، قرر القاضي العسكري التريث الى أن يطلع على تقرير لجنة تقصي الحقائق قبل البت في طلب محامي المدعى عليهم، بأن يطبق قانون المصالحة الوطنية على المدعى عليهم وذهب القاضي الى القول بأنه لا غنى عن التقرير لتحديد هل ينطبق العفو العام المنصوص عليه في ذلك القانون على هذه الحالة أم لا)٤٩٢(.

10. With the designation of the Peace Secretariat (SEPAZ) as the State agency responsible for the Government's policy of compensation for and/or assistance to victims of human rights violations, the Government complied with this commitment and with the provisions of article 9 of the National Reconciliation Act (Decree No. 145-96), which provides that such assistance shall be coordinated by SEPAZ.
١٠ - بعد تشكيل أمانة السلام، بوصفها الجهاز الحكومي المكلف بالسياسة العامة لتقديم التعويض أو المساعدة، أو كليهما، إلى ضحايا انتهاكات حقوق اﻹنسان، تكون الحكومة قد أوفت بهذا الالتزام ونصت عليه في المادة ٩ من قانون المصالحة الوطنية )المرسوم ١٤٥ - ٩٦(، الذي ينص على أن المساعدة المذكورة ستنفذ بتنسيق من أمانة السلام.

It is also important to recall that article 10 of the National Reconciliation Act (Decree No. 145-96) instructs the Clarification Commission to devise means whereby the historical truth about the period of internal armed conflict might be uncovered and acknowledged, in order to avoid a recurrence of such events, and adds that State bodies or entities must give the Commission whatever assistance it requires to that end.
ومن الجدير بالذكر كذلك أن قانون المصالحة الوطنية )المرسوم رقم ١٤٥/٩٦( يخول، في المادة ١٠ منه، لجنة بيان الانتهاكات " وضع التدابير التي من شأنها معرفة الحقائق التاريخية المتعلقة بفترة النزاع الداخلي المسلح والاعتراف بهذه الحقائق بغية تجنب تكرر مثل هذه اﻷعمال " . وباﻹضافة الى ذلك، أكد هذا القانون أن " على أجهزة وكيانات الدولة أن تقدم في هذا الصدد الى اللجنة كل ما تطلبه من دعم " .
